<br />153 <br /> <br />regular meeting, may 15, 1978 <br /> <br />page two <br /> <br />David Morrison was present to request the rezoning on <br />behalf of the applicant, L. O. Backus. Reuben Meeks, <br />representing Nelson Shopping Center, was present to <br />object to the zoning change. Mr. Arredondo moved the <br />ordinance be denied. Mr. Hansen seconded the motion. <br />On roll call, the following vote was recorded: <br /> <br />Aye: <br />Nay: <br /> <br />Arredondo, Hansen <br />Breihan, Cavazos, Hyatt, James <br />Sutton. <br /> <br />I <br /> <br />The Mayor declared the motion failed. Mr. Hyatt moved <br />the ordinance be approved on second reading. Mr. Breihan <br />seconded the motion. On roll call, the following vote <br />was recorded: <br /> <br />Nay: <br /> <br />Breihan, Cavazos, Hyatt, James, <br />Sutton <br />Arredondo, Hansen. <br /> <br />Aye: <br /> <br />The Mayor declared the ordinance not approved since a <br />three-fourths majority vote was required to pass the <br />ordinance over the recommendation of the Planning and <br />Zoning Commission to deny same. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF 12.64 ACRES IN <br />J. M. VERAMENDI SURVEY NUMBER TWO, <br />FURTHER DESCRIBED BY METES AND BOUNDS <br />IN ATTACHED "EXHIBIT A", AND LOCATED <br />AT THE CORNER OF RIVER ROAD AND BUGG <br />LANE, FROM "R-1" (SINGLE FAMILY <br />RESIDENTIAL) TO "D" (MULTIFAMILY). <br /> <br />I <br /> <br />Mr. Hyatt moved the ordinance be approved on second <br />reading. Mr. Hansen seconded the motion which passed <br />unanimously. <br /> <br />The Mayor introduced for consideration bids received <br />for the construction of a mental health/mental <br />retardation service facility to be operated as Scheib <br />Opportunity Center. Mr. Ken Rehler, architect for the <br />project to be financed in part through the City's <br />Community Development Program recommended the bid be <br />awarded to Lamar Constructors in the amount of <br />$229,361.00, that a change order in the amount of $11,588 <br />be approved, and that the City agree to provide certain <br />labor and assistance. That recommendation is attached <br />and made a part of these minutes. Mrs. Kathleen Morris, <br />Chairman of the Board of Directors for Souths ide <br />Community Center, discussed the project with the Council. <br />Mr. Hyatt moved the basic contract with Lamar Constructors <br />in the amount of $229,361.00 be approved. Mr. Hansen <br />seconded the motion, which passed unanimously. Council <br />discussed the possibility of receiving assistance from <br />the County on site work or additional funding. <br />Mr. Arredondo moved to allocate $7,500.00 from Revenue <br />Sharing Entitlement #9 to fund the change order and to <br />instruct the Staff to look for additional funding. <br />Mr. James seconded the motion which passed unanimously. <br /> <br />I <br />
