170 regular meeting, june 12, 1978 page four The Mayor read the caption of a resolution as follows: A .RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING ACCEPTANCE OF THE COMPLETION OF SLUDGE DRYING BEDS AT THE CONTACT STABILIZATION PLANT IN SAN MARCOS, TEXAS; AUTHORIZING FINAL PAYMENT FOR THIS CONSTRUCTION; AND ESTABLISHING AN EFFECTIVE DATE. I Mr. Hansen moved the resolution be adopted. Mr. Breihan seconded the motion which passed unanimously. The Mayor read the caption of a resolution as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUTHORIZING ACCEPTANCE OF THE COM- PLETION OF THE CONSTRUCTION OF AN EIGHT 'INCH WATER MAIN UNDER I. H. 35 SOUTH IN SAN MARCOS, TEXAS; AUTHORIZ- ING FINAL PAYMENT FOR THIS CONSTRUCTION; AND ESTABLISHING AN EFFECTIVE DATE. Mr. Hansen moved the reso1ut~on be adopted. Mr. Sutton seconded the motion which passed unanimously. The Mayor read an ordinance having the following capt~on: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMEND- ING CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, ENTITLED "PUBLIC SAFETY", SAID ORDINANCE BEING RECORDED IN VOLUME 45, PAGE 172 OF THE MINUTES OF THE CITY COUNCIL; AND ESTABLISHING AN EFFECTIVE DATE. I Mr. James moved the ordinance be approved on f~rst read~ng. Mr. Hyatt seconded the motion which passed unanimously. The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMEND- ING ARTICLE II, SECTION B, "DEFIt'lITIONS", SUBSECTION 39, "SUBDIVISIONS"; AND DECLARING AN EFFECTIVE DATE. Mr. James moved the ordinance be approved on second reading. Mr. Hansen seconded the motion which passed unanimously. At 9:00 p.m., Mr. Hansem moved the meeting recess to executive session to discuss personnel and pending l~tigation. Mr. Arredondo seconded the motion which passed unanimously. The meeting reconvened at 10:45 p.m. on motion of Mr. James and second of Mr. Hyatt. The Mayor reported that the Council had received a report from the audit firm regarding I the contract for this year's audit and directed the Staff to prepare a resolution authorizing execution of the contract with Harold V. Simpson and Company. Mr. Cavazos also report- ed that the Council had discussed the Lower Colorado River Authority rates case and moved to authorize the City Attorney to advise the special legal counsel, Don Butler, and the Lower Colorado River Authority and Public Utilities Commission that the Council was willing to continue with the 1977 rates as interim rates and that an ordinance to that effect would be adopted at the next regular council meeting.
