H. 35 <br />SOUTH IN SAN MARCOS, TEXAS; AUTHORIZ- <br />ING FINAL PAYMENT FOR THIS CONSTRUCTION; <br />AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Hansen moved the reso1ut~on be adopted. Mr. Sutton <br />seconded the motion which passed unanimously. <br /> <br />The Mayor read an ordinance having the following capt~on: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING CHAPTER 21 OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, <br />ENTITLED "PUBLIC SAFETY", SAID ORDINANCE <br />BEING RECORDED IN VOLUME 45, PAGE 172 <br />OF THE MINUTES OF THE CITY COUNCIL; AND <br />ESTABLISHING AN EFFECTIVE DATE. <br /> <br />I <br /> <br />Mr. James moved the ordinance be approved on f~rst read~ng. <br />Mr. Hyatt seconded the motion which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING ARTICLE II, SECTION B, "DEFIt'lITIONS", <br />SUBSECTION 39, "SUBDIVISIONS"; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. James moved the ordinance be approved on second reading. <br />Mr. Hansen seconded the motion which passed unanimously. <br /> <br />At 9:00 p.m., Mr. Hansem moved the meeting recess to <br />executive session to discuss personnel and pending l~tigation. <br />Mr. Arredondo seconded the motion which passed unanimously. <br />The meeting reconvened at 10:45 p.m. on motion of Mr. James <br />and second of Mr. Hyatt. The Mayor reported that the <br />Council had received a report from the audit firm regarding I <br />the contract for this year's audit and directed the Staff <br />to prepare a resolution authorizing execution of the contract <br />with Harold V. Simpson and Company. Mr. Cavazos also report- <br />ed that the Council had discussed the Lower Colorado River <br />Authority rates case and moved to authorize the City Attorney <br />to advise the special legal counsel, Don Butler, and the <br />Lower Colorado River Authority and Public Utilities Commission <br />that the Council was willing to continue with the 1977 rates <br />as interim rates and that an ordinance to that effect would <br />be adopted at the next regular council meeting. Mr. Hansen <br />seconded the motion which passed unanimously. Mr. Cavazos <br />reported that the Council had also briefly discussed a suit <br />
