<br />regular meeting, june 12, 1978 <br /> <br />page three <br /> <br />169 <br /> <br />The Mayor opened a public hearing to consider a request for <br />a change in the zoning of Lot 26, Block 1 of the Zack <br />Williamson Addition located at the corner of Marlton and <br />Baylor Avenue, from "R_ltl to "e". The applicant, Mr. Joe <br />K. Dobie, came before the Council to request the zoning <br />change. No objections were pre~ented to the requested <br />change. The Mayor closed the hearing and read an ordinance <br />having the following caption: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />.THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOT 26, BLOCK I <br />OF THE ZACK WILLIAMSON ADDITION, LOCAT- <br />ED AT THE CORNER OF MARLTON AND BAYLOR <br />AVENUE, EROM "R-I" (SINGLE FAMILY <br />RESIDENTIAL) TO "C" (COMMERCIAL). <br /> <br />Mr. Hyatt moved the ordinance be approved on first reading. <br />Mr. Sutton seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: <br /> <br />Sutton, Arredondo, Breiban~ H,ansen, <br />Cavazos, J{yatt <br />James <br /> <br />NAY: <br /> <br />I <br /> <br />The Mayor opened a public hearing on a request for a change <br />in the zoning of two tracts of land in the J. M. Veramendi <br />League Number Two containing approximately 4.153 acres from <br />"R-l" to "n". The applicant, George C. Haines, was repre-- <br />sented by Realtor, John McCrocklin. Mr. McCrocklin pointed <br />out that the comprehensive plan indicated the property was <br />suitable for multifamily zoning and that much of the surround- <br />ing property was zoned commercial us"age. Mrs. Eloisa Hernandez, <br />who owns property adjacent to the subject tract, came forward <br />to state her objection to the zoning change. Represented by <br />her son, Richard Hernandez, Mrs. Hernandez and others in the <br />area, complained about. the increase in traffic on Bugg Lane <br />as well as potential drainage and other problems. A petition <br />was presented in objection, said petition may be found in <br />the official zoning file. Also speaking an objection to the <br />zoning change were Richard Cruz and Margie and Rudy Villalpando. <br />The Mayor closed the hearing and read an ordinance having the <br />following caption: <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL Of <br />THE CITY OF SAN MARCOS, TEXAS, AMEND- <br />ING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAy 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF TWO TRACTS OF <br />LAND IN J. M. VERAMENDI LEAGUE NO.2, <br />CONTAINING APPROXIMATELY 4.153 ACRES, <br />LOCATED BETWEEN BUGG LANE AND STATE <br />HIGHWAY 80, FROM "R-1" (SINGLE FAMILY <br />RESIDENTIAL) TO "D" (MULTIFAMILY). <br /> <br />Mr. Breihan moved the ordinance be approved on first reading. <br />Mr. James seconded the motion. Mr. Breihan requested further <br />engineer"iog information on the area prior,to'the second and <br />third readings of the ordinance. On roll call, the following <br />vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Breihan, Hansen, Hyatt <br />Cavazos, James, Sutton, Arredondo <br /> <br />The Mayor declared the motion failed and the ordinance not <br />approved. <br />
