I I I 76 MINUTES OF A REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JULY 18, 1977. Present: Mayor Frank T. The Mayor called the meeting to order at 7:30 p.m. Mr. Sutton moved the Minutes of the Regular Meeting held July 11, 1977 be approved as presented. Mr. James seconded the motion. Mr. Breihan requested that Page 2, Paragraph 3, Line 14 be corrected to read "Street Department" instead of "Sanitation Department". Mr. Sutton and Mr. James agreed to the correction on rollcall, the Minutes were unanimously approved as corrected. Mr. Sutton moved approval of the renewal of a temporary to allow R.L. Boggus to locate a mobile home on Lot 4, Block 3 of the McAllister Addition, 1128 West San Antonio Street. Mr. Hansen seconded the motion which passed unanimously. Mr. Hansen moved to approve the renewal of a temporary permit to allow Melvin P. Durham to locate a mobile home on Lots 95 & 96, Block 11 of the Westover addition, Delmar and Baylor Street intersection. Mr. James seconded thE' motion which passed unanimously. Mr. Hansen moved approval of a temporary permit to allow Caterino Villalpando to locate a mobile home on part of Division G, Farm Lot 10, 318 South Johnson Street. Mr. James seconded the motion which passed unanimously. The Mayor opened a Public Hearing to consider a request for a change in the zoning of Lot 113 of the Park Addition, Third Division, from "c" to "C-2". The Planning and Zoning Commission's recommendation is to deny the request. The applicant, Lyndon Herring was present and represented by attorney, Andrew Gary. Mr. Gary stated his contention that denial of the requested zoning change would be discriminatory since property across the street: on either side of Lot 113 was already zoned and in use as "C-2". Mr. Gary told the Counc,il his cll planned to use the property for a Beer Garden and that no permanent structure was contemplated. Questioned by the Mayor, Mr. Gary said off street parking of up to 17 spaces would be available. Residents in the area, including ~lr. Curtis Jenkins and Dr. Pat Norwood, came before the Council to object to the increase in traffic and parking problems and the increase in noise lat., at night which would disturb nearby residents. The Mayor closed the hearing and read an ordinance having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING SECTION III OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND 'LANDS, DATE MAY 23, 1966, VOLUME 32, BY CHANGING THE ZONING OF LOT 113 OF THE PARK ADDITION, THIRD DIVISION, LOCATED AT THE INTERSECTION OF CHESTNUT AND L.B.J. DRIVE FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL).
