<br />87. <br /> <br />regular meeting, july 25, 1977 <br /> <br />page two <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION THREE OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, <br />DATED MAY 23, 1966 (Vol. 32) BY CHANGING THE ZONING OF A 15.51 ACRE TRACT <br />OF LAND IN THE J.M. VERAMENDI SURVEY NUMBER TWO, ABSTRACT SEVENTEEN <br />LOCATED NEAR THE INTERSECTION OF INTERSTATE HIGHWAY 35 NORTH FRONTAGE <br />ROAD WITH THE MKT RAILROAD, FROM "c" (COMMERCIAL) TO "I" (INDUSTRIAL). <br /> <br />Dr. Craddock moved the Ordinance be approved on second reading. Mr. James <br />seconded the motion. Onrroll call the following vote was recorded: <br /> <br />AYE: Hansen, James, Sutton, Cavazos, Craddock, Arredondo <br />NAY: None <br />ABSTAIN: Breihan <br /> <br />I <br /> <br />The Mayor re~d the caption of a resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />AUTHORIZING THE ACTING CITY MANAGER TO SUBMIT A GRANT APPLICATION <br />TO THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION <br />OFFICE OF TRAFFIC SAFETY FOR FUNDS FOR THE CONTINUED EMPLOYMENT BY <br />THE CITY OF A TRAFFIC SAFETY COORDINATOR. <br /> <br />Mr. Sutton moved the Resolution be adopted. Mr. James seconded the motion. <br />Mr. Terry Palmer from the State office of Traffic Safety came before the Council <br />to tell them that the grant would fund the salary and benefits of the Traffic <br />Safety Coordinator as well as some travel expenses and furniture. In response <br />to a question from Mr. Sutton Mr. Palmer also said that it was not mandatory <br />for the City to continue funding the program when the state funds ran out. <br />Mr. Breihan expressed a conCErn for traffic hazards near the schools and asked <br />that those problems be given a top priority. On roll call the motion to adopt <br />the resolution was unanimously approved. <br /> <br />Dr. Craddock moved that a Resolution adopting a contract for engineering <br />services be removed from the table. Mr. Hansen seconded the motion which passed <br />unanimously. The Mayor read the caption of the Resolution as follows: <br />"i-r'\ <br /> <br />I <br /> <br />A RESOLUTION'DF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING;A €ONTRACT FOR SERVICES BETWEEN THE CITY OF SAN MARCOS <br />AND FORREST & COTTON, INC., AND JAMES E. BYRN FOR THE PURPOSE OF <br />PROVIDING ENGINEERING SERVICES FOR ACTION YEAR THREE, UNDER THE <br />HOUSING AND COMMuNITY DEVELOPMENT ACT BLOCK GRANT AND AUTHORIZING THE <br />MAYOR'OF'SAID CITY TO EXECUTE THE SAME IN BEHALF OF THE CITY. <br /> <br />Mr. James moved the Resolution be adopted. Mr. Hansen seconded the motion. <br />Mr. Sutton began the discussion by stating his cOncern that there was a <br />definite'conflict' of interest on.the .part of James E. Byrn due to fact that <br />he was able to gain extra benefits through his contracts with the City for <br />engineering work done for other persons in the community. Mr. James stated <br />his feeling that it was beneficial to have a project engineer who was also <br />a resident of the City. The City Attorney pointed out that all engineers <br />were subject to the code of responsibility as formulated by the State Board. <br />Roy Porter, representing Forrest & Cotton, encouraged the Council to ask <br />the State Board to investigate the situation to alleviate the City's concern. <br />The Council also discussed the cost of engineering services with Mr. Byrn <br />and Mr. Porter. Mr. Breihan recommended the City approve placing the inspectors <br />directly under the supervision of the engineer.and suggested the Council put <br />off the matter until the new City Manager were hired. On roll call the motion <br />to approve the Resolution was passed by the following vote: <br /> <br />AYE: Breihan, Cavazos, Craddock, Arredondo, Hansen, James <br />NAY: Sutton <br /> <br />I <br /> <br />The Mayor read the caption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPOINTING BLAS MENDEZ, LUPE PICASIO AND KATHLEEN BONSALL AS DEPUTY <br />COURT CLERKS OF THE SAN MARCOS MUNICIPAL COURT. <br /> <br />Dr. Craddock moved the Resolution be adopted. Mr. Hansen seconded the motion, <br />which passed unanimously. <br />
