Dr. Craddock seconded the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration acceptance of the C.M. Allen <br />and Cheatham Street project under the Community Development Program. <br />Consulting engineers have recommended final payment to the contractor, <br />Dean Word Company, in the amount of $35,229.51. Mr. James moved the <br />project be accepted subject to the contractor furnishing the City <br />with a release in satisfaetory form of all claims against the City <br />arising aut of the contract. Mr. Breihan seconded the motion which <br />passed unanimously. <br /> <br />The Mayor next introduced consideration of acceptance of the First <br />Year Drainage Confluence prog~am under Community Development. Dr. <br />Craddock moved the project be accepted as recommended by the <br />consulting engineers. Mr. James seconded the motion. Mr. Breihan <br />stated that he was not ready to reeeive the project until certain <br />items had been eorrected. The City Manager pointed out that monies <br />were being withheld to solve some problems on the job. Questioned <br />by Mr. Breihan, Mr. Evans said that he felt there was possibly a <br />problem with the wording of the letter of recommendation from Forrest <br />and Cotton in terms of making claims against the contractor's bonding <br />company in the event defects in the work were discovered in the future. <br />Mr. Hansen moved the consideration of acceptance of the project be <br />tabled until the Council could receive a report from consulting engineers <br />on the present condition of the project. Dr. Craddock seconded the <br />motion which passed unanimously. <br /> <br />Councilman James moved to accept the Bluebonnet Hills Improvements <br />project under Community Development subject to the contractor's <br />furnishing the City with a release in satisfactory form of all claims <br />against the City arising under the contract.. Dr. Craddock seconded <br />the motion which passed unanimously. <br /> <br />Mr. Hansen moved the meeting regularly scheduled for September 5, 1977 <br />(observed as Labor Day) by City Staff be cancelled. Dr. Craddock <br />seconded the motion.
