<br />f.' <br />"164 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AND ADOPTING AMENDMENT #5 TO THE URBAN RENEWAL PLAN FOR <br />N.D.P. PROJECT TEX. A-6, DIRECTING THAT SAID CHANGE BE FILED AS A <br />PART OF THE URBAN RENEWAL PLAN FOR SAID PROJECT, AND PROVIDING AN <br />EFFECTIVE PLAN. <br /> <br />Mr. Breihan moved the Ordinance be adopted on third and final reading. <br />Dr. Craddock seconded the motion which passed unanimously. <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING ORDINANCE NUMBER 1974-48 APPROVED ON SEPTEMBER 9, 1974 <br />AND OF RECORD IN VOLUME 44, PAGE 47, OF THE MINUTES OF THE CITY <br />COUNCIL TO EXCLUDE A CERTAIN TRACT FROM THE SITE SET ASIDE TO THE <br />TEXAS MUSEUM OF HISTORY, INC. FOR A MUSEUM, AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Hansen moved the Ordinance be adopted on third and final reading. <br />Dr. Craddock seconded the motion which passed unanimously. <br /> <br />The Mayor introduced a request from Phillip Guerrero for a permit to <br />temporarily locate a mobile home on Lot 22, Block 1 of the J. M. Stone <br />Addition, 206 Mitchell Street. Mr. Arredondo noted that the Planning and <br />Zoning Commission had recommended approval of the request and that no <br />objectives had been received. Mr. Cavazos moved the permit be approved. <br />Dr. Craddock seconded the motion which passed unanimously. <br /> <br />The Mayor introduced Mr. Don Butler, Special Legal Council for the City, <br />who came before the Council to discuss the recent ruling of the Public <br />Utilities Commission with regard to retail rates for the city of Kerrville <br />to be charged by the Lower Colorado River Authority. Mr. Butler stated <br />his contention that the rates established by the Commission were arbituary <br />and discriminatory, and furthermore, that the rates established were higher <br />than those requested by the Lower Colorado River Authority. Mr. Butler <br />told the Council that the rates were for the city of Kerrville and that <br />they were not applicable to the city of San Marcos. Mr. Butler said the <br />City Council had several options with regard to the request by the Lower <br />Colorado River Authority for a change of retail rates structure for <br />San Marcos. He said the Council could take no action and allow the rates <br />to become effective automatically; the Council could modify, deny the request, <br />or approve the request made by the Lower Colorado River Authority; or the <br />Council could suspend the request for a period of 150 days and require further <br />information of the Authority. The MaY9r next introduced Senator Charles Herring, <br />Executive Director of the Lower Colorado River Authority, who came before the <br />Council that the Authority felt a need to have consistent retail rates for all <br />cities served by Lower Colorado River Authority, not separate schedules for <br />each city. The Mayor then opened a public hearing to receive comments on the <br />Lower Colorado River Authority request from members of the audience. The <br />Council also discussed the cost of supplying electricity to San Marcos with <br />representatives of Lower Colorado River Authority. Dr. John Dennison, City Rate <br />Consulter, informed the Council that he could not recommend that the Public <br />Utilities Commission rate established for the city of Kerrville be accepted in <br />San Marcos. He recommended that the Council evaluate the Lower Colorado River <br />Authority request as though the Public Utilities Commission had not ever met. <br />The Mayor closed the public hearing at 8:40 p.m. Dr. Craddock moved to direct <br />the staff provide a resolution requesting Lower Colorado River Authority <br />provide data for the last test year just ended, and also a resolution requiring <br />120 days delay on the proposed request for a rate change. Mr. Hansen seconded <br />the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration the City's Sanitary Landfill Operation. <br />The City Manager summarized a memorandum he had written to the City Council <br />dated November 11, 1977 giving seven recommendations which regard to the landfill <br />operation. Mr. Webster said he felt the Council should accept the results of <br />the State Department of Health Resources hearing examiner; that the City should <br />begin to implement a recycling program; that the City should pursue a fight for <br />the disposal of brush only; that the City should proceed with the purchase of a <br />new compacter; that within one year from today the City should request an <br />amendment to our permit based upon available information as to the anticipated <br />future life of the fight; that the Council should review immediately landfill <br /> <br />I <br /> <br />I <br /> <br />I <br />
