Mr. James seconded the <br />motion which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, AMENDING ORDINANCE 1979-l3, <br />ADOPTED MARCH 26, 1979, WHICH AMENDED CHAPTER I <br />2 1/2 OF THE CODE OF ORDINANCES OF THE CITY OF SAN <br />MARCOS, ENTITLED "ALCOHOLIC BEVERAGES" BY PROVIDING <br />FOR A NEW COMPREHENSIVE LOCAL PUBLIC POLICY REGARDING <br />THE POSSESSION, SALE, AND CONSUMPTION OF ALCOHOLIC <br />BEVERAGES: BY CHANGING THE REQUIREMENTS PERTAINING <br />TO PRIVACY FENCES: BY ELIMINATING THE "HARD SURFACE" <br />REQUIREMENT FOR OFF STREET PARKING AREA; BY CHANGING <br />THE REQUIREMENTS FOR NUMBER OF PARKING SPACES; BY <br />EXEMPTING ESTABLISHMENTS LOCATED IN A "C-2" COMMERCIAL <br />DISTRICT ON NOVEMBER 20, 1978, AND DISPENSING LIQUOR, <br />WINE OR BEER FOR ON-PREMISE CONSUMPTION UNDER PERMIT BY <br />THE STATE OF TEXAS ON SAID DATE FROM PARKING REQUIREMENTS. <br />BY SETTING PROCEDURES FOR RENEWAL OR REAPPLICATION FOR <br />A CONDITIONAL USE PERMIT SHALL OCCUR ONLY UPON THE FILING <br />OF A WRITTEN STATEMENT; BY DELETING EXAMPLES OF GROUNDS <br />FOR EMERGENCY SUSPENSION; BY SPECIFYING THAT WRITTEN NOTICE <br />SHALL BE PROVIDED TO THE HOLDER AND/OR OWNER OF THE <br />CONDITIONAL USE PERMIT PRIOR TO THE FILING OF A COMPLAINT <br />IN MUNICIPAL COURT; BY DELETING A STATEMENT OF CONSENT <br />TO ENTRY OF OFFICIALS AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mr. Tenorio moved the ordinance be adopted on third and final <br />reading. Mr. Hyatt seconded the motion which passed unanimously. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING THE PRICE AND CONDITIONS OF <br />THE SALE BY THE CITY OF SAN MARCOS, TEXAS, OF PART OF <br />PARCEL NO. 10-1, DESCRIBED FURTHER ON EXHIBIT "A" <br />ATTACHED HERETO, LOCATED WITHIN THE TEX. A-6, NEIGHBOR- <br />HOOD DEVELOPMENT PROGRAM AREA, TO JOHNNY L. FINCH AND <br />JAMES DONNELLEY; AND AUTHORIZING THE MAYOR TO EXECUTE <br />A WARRANTY DEED TO JOHNNY L. FINCH AND JAMES DONNELLEY. <br /> <br />I <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />Mr. Hyatt moved the ordinance be approved on second reading. Mr. <br />James seconded the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration provision of fire protection <br />service to areas located outside the City limits. The Acting City <br />Manager reported to the Council that a new offer had been made by <br />County officials of $12,000 to fund the cost of fire protection in <br />the County outside the City limits. Mr. Minnie told the Council that <br />the City does not use its Class A firefighting equipment when responding <br />to calls outside the City limits. Mr. Sutton moved to approved <br />acceptance of $12,000 from Hays County Commissioners for fire service <br />for the 1979-80 fiscal year. Mr. Breihan seconded the motion.
