95 regular meeting november 5, 1979 page two stating that the residents in the area desired to keep the neighborhood zoned for single-family residential use. Also opposing the zoning change were Doris Connelley, James Ford, Arnold Leder, Karl Brown of the Oak Heights Neighborhood Association, and Dr. Ken Long. Council member Tenorio pointed out that all the surrounding property was currently zoned for single-family residential use and that the only property not used for that purpose enjoyed a commercial non-conforming status. It was noted that the Planning & Zoning Commission requested that the request be disapproved. Following the public hearing, the I ordinance was read in its entirety. The caption of the ordinance is as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOTS 3 & 4 OF BLOCK 3 OF THE MCNAUGHTON ADDITION LOCATED ON THE NORTHEAST CORNER OF ORCHARD AND ACADEMY STREETS FROM R-l (SINGLE FAMILY RESIDENTIAL) TO D (MULTI-FkMILY). Mr. Hyatt moved the ordinance not be approved. Mr. Tenorio seconded the motion which passed unanimously. The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF APPROXIMATELY l.l67 ACRES OUT OF THE T. J. CHAMBERS SURVEY FURTHER DESCRIBED BY METES AND I BOUNDS IN THE ATTACHED EXHIBIT A LOCATED AT l244 NORTH LBJ DRIVE FROM R-l (SINGLE FAMILY RESIDENTIAL) TO D (MULTI-FAMILY). Mr. James moved the ordinance be approved on seg~nd reading. Mr. Hyatt seconded the motion. The City Managerpeported to the Council that the Staff had discussed the rezoning and wiS'hed to advise the Council that they felt it would create problems for the future improvement of LBJ Drive since there was not adequate right-of-way for the eventual widening of the street. On roll call, the motion to approve the ordinace passed unanimously. The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION l5.2, ENTITLED "TEMPORARY USE OF LAND BY MOBILE HOMES" OF APPENDIX A, ENTITLED "GENERAL ZONING ORDINANCE" OF THE CODE OF ORDINANCES OF SAID CITY BY DELETING THE PROVISION WHICH MANDATES DENIAL OF AN APPLICATION FOR A PERMIT TO TEMPORARILY PLACE A MOBILE HOME UPON OPPOSITION BY AN OWNER OF LAND WITHIN TWO HUNDRED (200) FEET IN EACH DIRECTION; BY DELETING THE PROVISION WHICH ALLOWS THE OWNER OF PROPERTY I WITHIN TWO HUNDRED (200) FEET OF THE PROPOSED LOCATION TO CAUSE REMOVAL OF THE MOBILE HOME AND DECLARING AN EFFECTIVE DATE.
