<br />95 <br /> <br />regular meeting <br /> <br />november 5, 1979 <br /> <br />page two <br /> <br />stating that the residents in the area desired to keep the neighborhood <br />zoned for single-family residential use. Also opposing the zoning <br />change were Doris Connelley, James Ford, Arnold Leder, Karl Brown of <br />the Oak Heights Neighborhood Association, and Dr. Ken Long. Council <br />member Tenorio pointed out that all the surrounding property was <br />currently zoned for single-family residential use and that the only <br />property not used for that purpose enjoyed a commercial non-conforming <br />status. It was noted that the Planning & Zoning Commission requested <br />that the request be disapproved. Following the public hearing, the I <br />ordinance was read in its entirety. The caption of the ordinance <br />is as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE <br />LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING <br />THE ZONING OF LOTS 3 & 4 OF BLOCK 3 OF THE <br />MCNAUGHTON ADDITION LOCATED ON THE NORTHEAST <br />CORNER OF ORCHARD AND ACADEMY STREETS FROM R-l <br />(SINGLE FAMILY RESIDENTIAL) TO D (MULTI-FkMILY). <br /> <br />Mr. Hyatt moved the ordinance not be approved. Mr. Tenorio seconded <br />the motion which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT <br />ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED <br />MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF APPROXIMATELY l.l67 ACRES OUT OF THE T. J. <br />CHAMBERS SURVEY FURTHER DESCRIBED BY METES AND I <br />BOUNDS IN THE ATTACHED EXHIBIT A LOCATED AT <br />l244 NORTH LBJ DRIVE FROM R-l (SINGLE FAMILY <br />RESIDENTIAL) TO D (MULTI-FAMILY). <br /> <br />Mr. James moved the ordinance be approved on seg~nd reading. Mr. <br />Hyatt seconded the motion. The City Managerpeported to the Council <br />that the Staff had discussed the rezoning and wiS'hed to advise the <br />Council that they felt it would create problems for the future improvement <br />of LBJ Drive since there was not adequate right-of-way for the <br />eventual widening of the street. On roll call, the motion to approve <br />the ordinace passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION l5.2, ENTITLED <br />"TEMPORARY USE OF LAND BY MOBILE HOMES" OF APPENDIX <br />A, ENTITLED "GENERAL ZONING ORDINANCE" OF THE <br />CODE OF ORDINANCES OF SAID CITY BY DELETING THE <br />PROVISION WHICH MANDATES DENIAL OF AN APPLICATION <br />FOR A PERMIT TO TEMPORARILY PLACE A MOBILE HOME <br />UPON OPPOSITION BY AN OWNER OF LAND WITHIN TWO <br />HUNDRED (200) FEET IN EACH DIRECTION; BY DELETING <br />THE PROVISION WHICH ALLOWS THE OWNER OF PROPERTY I <br />WITHIN TWO HUNDRED (200) FEET OF THE PROPOSED <br />LOCATION TO CAUSE REMOVAL OF THE MOBILE HOME AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Tenorio m0ved the ordinance be approved on second reading.
