Mr. Breihan <br />said he wanted to discuss the matter to find out why the request for <br />extension of the City's landfill permit had been withdrawn. The <br />City Manager requested that the Council discuss the question in executive <br />session to avoid any possible generation of possible litigation which <br />might arise due to public statements made in connection with the <br />question. Mr. Hyatt objected to an executive session discussion <br />of the landfill permit after being informed by the City Attorney that <br />she knew of no pending litigation regarding the landfill permit or <br />operation. Mr. James moved the Council recess to executive session. I <br />Mr. Sutton seconded the motion. On roll call the following vote <br />was recorded: <br /> <br />AYE: Hansen, James, Sutton, Tenorio <br /> <br />NAY: Breihan, Hyatt <br /> <br />The meeting recessed to executive session at 9:47 p.m. The meeting <br />was reconvened in regular session at lO:OO p.m. on motion of Mr. <br />James and second of Mr. Tenorio. The Mayor reported that the Council <br />had been informed that the topic under discussion was not suitable <br />for an executive session. Mr. Breihan moved to direct the City Attorney <br />to compile the data on the withdrawal of the landfill extension and <br />bring back a report at the next regular Council meeting. Mr. Breihan <br />further moved to direct the City Manager and City Staff to cooperate <br />with the City Attorney on the requested report. Mr. Tenorio seconded <br />the motion which passed unanimously. Mr. Sutton stated that he also <br />wanted a report on the garbage collection system from the City Manager. <br />The City Manager informed the Council that he was opposed to giving <br />the requested information to the City Attorney, but that he would <br />comply at the direction of the City Council.** <br /> <br />Mr. James moved to call a work session for 5:00 p.m., Monday, November <br />19t~ and a special meeting on the same day at 7:30 p.m. to discuss <br />the water and wastewater rate proposal and to consider second reading I <br />of that ordinance. Mr. Hyatt seconded the motion which passed <br />unanimously. Mr. Gonzalez <br />concurred that such a study was needed and said he would be able to <br />give the Council an outline of some of the areas which needed <br />attention by the November 26th meeting. <br /> <br />L <br />
