<br />?p <br /> <br />regular meeting, april 9, 1973 <br /> <br />page four <br /> <br />The Mayor introduced an ordinance and read the caption <br />as follows: <br /> <br />AN ORDINANCE RELATING TO PLACEMENT FOR COLLECTION <br />THEREFROM AND REMOVAL THEREAFTER OF GARBAGE AND TRASH <br />CANS; AMENDING SECTION 12-5 OF THE CODE OF ORDINANCES <br />OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED "PLACEMENT <br />FOR COLLECTION", BY DENOMINATING THE PRESENT SECTION <br />AS (al, AND BY ADDING A NEW SECTION (b) GOVERNING THE <br />REMOVAL OF GARBAGE AND TRASH CANS AFTER COLLECTION <br />THEREFROM. <br /> <br />I <br /> <br />Dr. Tauch moved the ordinance be approved on second reading. <br />Mr. Yarbrough seconded the motion. Dr. Tauch stated that he <br />had given the matter a great deal of consideration following <br />the last Council meeting, and that he was concerned that some <br />provision for persons not able to comply with the ordinance <br />were necessary. Several alternatives were discussed. Mayor <br />Etheredge requested that the ordinance be tabled until further <br />study could be made. Dr. Tauch withdrew his motion to approve <br />the ordinance with consent of the seconder. Mr. Yarbrough <br />moved to table the ordinance. Dr. Tauch seconded the motion <br />which passed unanimously. <br /> <br />Mr. Yarbrough moved to appoint Ben McCollum to the Board of <br />Equalization. Mr. King seconded the motion, which passed <br />unanimously. <br /> <br />Mr. King moved that Mayor Etheredge be appointed to serve on <br />the Chamber of Commerce Tourist Development Committee. <br />Mr. Yarbrough seconded the motion, which passed with six votes <br />in favor and Mr. Etheredge abstaining. <br /> <br />Councilman Cunningham read a Resolution (see attached) reSOlving <br />that the Council recommend the Texas legislature reduce the <br />penalties for possession of marijuana for personal use to a I <br />misdemeanor, and recommend a comprehensive drug education program <br />within the state and conscientious, equitable enforcement of <br />Texas drug laws. Mr. Cunningham moved approval of the <br />Resolution. Dr. Tauch seconded the motion, which passed <br />unanimously. <br /> <br />John Pfeffer came before the Council to request consideration <br />of repeal of the ordinance prohibiting the placement of posters <br />on utility poles. City Attorney Albert Walker stated that there <br />was no state statute regarding the matter. Mr. Pfeffer proposed <br />a permit system with procedure for fines if not complied with <br />to aid in the removal of posters. Mr. Etheredge appointed <br />Councilmen Cunningham and Yarbrough to a committee to study the <br />present ordinance and formulate alternatives. <br /> <br />In reply to a request from Councilman Yarbrough, the City Manager <br />stated that a proposal had been submitted to the Texas Education <br />Agency for exchange of property to provide more space for airport <br />facilities. He further stated that it would be necessary to <br />construct a fence to keep people off the runway, but that at <br />present an estimate of costs had not been made. <br /> <br />Mr. Etheredge introduced a request for a temporary permit to <br />locate a mobile home at 1023 Mead Street. He stated that the <br />location had previously been occupied by a HUD trailer. Mr. King I <br />moved the permit be granted. Dr. Tauch seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Etheredge stated his concern with the possibility of <br />annual floods and the need for some sort of "stop-gap" measure <br />until more permanent flood control measures could be implemented. <br />Councilman DeLa Rosa requested that he be allowed to serve on <br />a committee to study the problem. Mayor Etheredge appointed <br />Mr. DeLa Rosa and Councilmen King and Tauch to a committee to <br />study flood control measures. <br />
