Adcock <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />The Invocation was given by Councilman Yarbrough. <br /> <br />The Minutes of the April 9 meeting were approved on motion of <br />Mr. Yarbrough and second of Dr. Tauch, with Mr. Flores abstaining. <br /> <br />I <br /> <br />The Minutes of the Special Meeting of April 16 were approved on <br />motion of Mr. Yarbrough and second of Dr. Tauch, with Councilmen <br />Cunningham, DeLa Rosa and Flores abstaining. <br /> <br />The Minutes of the Special Meeting of April 17 were approved on <br />motion of Dr. Tauch and second of Mr. Cunningham, with Councilmen <br />De La Rosa and Flores abstaining. <br /> <br />Mayor Etheredge reported that the Council had met in Executive Session <br />on April 16 and discussed with attorneys the proposed litigation in <br />connection with a rate increase implemented by the Lower Colorado <br />River Authority. Councilman Flores moved that the law firm of <br />McGinnis, Lochridge and Kilgore of Austin be authorized to file <br />suit against the Lower Colorado River Authority for injunction and <br />declaratory judgement for the purpose of establishing the City's <br />jurisdiction over the electrical rates charged by the Authority <br />within the boundaries of the City of San Marcos and to prevent the <br />charging of rates in excess of those lawfully prescribed by the <br />City Council of the City of San Marcos. The motion was seconded by <br />Mr. Yarbrough, and on roll call, the following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Cunningham, De La Rosa, Etheredge, Flores, Tauch, Yarbrough <br />None <br /> <br />I <br /> <br />The Mayor opened a public hearing to consider a request for a change <br />in zonlng on Lot 10f the Coers Addition, located at 472 Holland <br />Street, trom "R-l" to "C". Fred Hinnenkamp, applicant, was present <br />to request the change. There were no objections made from those <br />present. The Mayor stated that a letter had been received from <br />a nearby property owner, Otis Reese, objecting to the change. The <br />M~yor declared the public hearing closed, and read the caption of <br />~an Ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING <br />THE ZONING OF LOT 1 OF THE COERS ADDITION, LOCATED AT <br />472 HOLLAi'YD STREET. FROM "R-l" (SINGLE FAMILY RESIDENTIAL) <br />TO "c" (COMMERCIAL). <br />
