Samuel Montoya; Manuel Castillo, jr.; Arturo Torres; W.P. Doherty; A.R. Adcock The Mayor called the meeting to order at 7:30 p.m. The Invocation was given by Councilman Yarbrough. The Minutes of the April 9 meeting were approved on motion of Mr. Yarbrough and second of Dr. Tauch, with Mr. Flores abstaining. I The Minutes of the Special Meeting of April 16 were approved on motion of Mr. Yarbrough and second of Dr. Tauch, with Councilmen Cunningham, DeLa Rosa and Flores abstaining. The Minutes of the Special Meeting of April 17 were approved on motion of Dr. Tauch and second of Mr. Cunningham, with Councilmen De La Rosa and Flores abstaining. Mayor Etheredge reported that the Council had met in Executive Session on April 16 and discussed with attorneys the proposed litigation in connection with a rate increase implemented by the Lower Colorado River Authority. Councilman Flores moved that the law firm of McGinnis, Lochridge and Kilgore of Austin be authorized to file suit against the Lower Colorado River Authority for injunction and declaratory judgement for the purpose of establishing the City's jurisdiction over the electrical rates charged by the Authority within the boundaries of the City of San Marcos and to prevent the charging of rates in excess of those lawfully prescribed by the City Council of the City of San Marcos. The motion was seconded by Mr. Yarbrough, and on roll call, the following vote was recorded: AYE: NAY: Cunningham, De La Rosa, Etheredge, Flores, Tauch, Yarbrough None I The Mayor opened a public hearing to consider a request for a change in zonlng on Lot 10f the Coers Addition, located at 472 Holland Street, trom "R-l" to "C". Fred Hinnenkamp, applicant, was present to request the change. There were no objections made from those present. The Mayor stated that a letter had been received from a nearby property owner, Otis Reese, objecting to the change. The M~yor declared the public hearing closed, and read the caption of ~an Ordinance as follows: AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOT 1 OF THE COERS ADDITION, LOCATED AT 472 HOLLAi'YD STREET. FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "c" (COMMERCIAL).
