Mr. Flores stated the granting <br />of "C-2" zoning was legal. His objection was a moral one. He <br />asked if a wall had been built for the purpose of achieving the <br />required 300 feet distance from El Buen Pastor Church. He was <br />told that was correct. Mr. Chavez presented a petition to the <br />Council signed by members of El Buen Pastor Methodist Church. <br />On roll call, the following vote was recorded: <br /> <br />6/11/73 <br />Tauch voted <br />"AYE" <br />&It <br /> <br />AYE: <br />NAY: <br /> <br />Etheredge <br />Cunningham, DeL a Rosa, Dibrell, Flores, King, ~ <br /> <br />The Mayor declared the motion failed and the request for a <br />zoning change denied. <br /> <br />I <br /> <br />The Mayor opened a public hearing to consider a request for a <br />change in zoning on Lots 8 and 9, Block 4 in the Mountain City <br />Addition; and the lots fronting on vista Street out of the <br />T.J. Chambers Survey owned by Billy Ray Brunson and Wayne O. <br />Cure, from "P-2" to "D". H.C. Kyle, III, spokesman for the <br />Planning and Zoning Commission, explained that the Commission <br />had requested the change so that the owners could more properly <br />use the land. There were no objections. The Mayor closed the <br />public hearing and read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH <br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING THE ZONING OF LOTS 8 AND 9 IN BLOCK 4 OF THE <br />MOUNTAIN CITY ADDITION; AND LOTS FRONTING ON VISTA STREET <br />OUT OF THE T.J. CHAMBERS SURVEY OWNED BY BILLY RAY BRUNSON <br />AND WAYNE O. CURE, FROM "P-2" (PUBLIC USE) TO "D" <br />(MULTIFAMILY) . <br /> <br />Mr. Flores moved the Ordinance be approved on first reading. <br />Mr. King seconded the motion, which passed unanimously. <br /> <br />Mr. Etheredge stated that the zoning change requested by <br />Robert Sauls had been withdrawn by Mac Sauls, owner of the <br />property. <br /> <br />I <br /> <br />The Mayor introduced a request for a permit to temporarily <br />locate a mobile home on Lot 23, Block 3 of the Benito Cruz Land, <br />located at 401 Laredo Street. Mr. King, noting the Planning and <br />Zoning Commission's negative recommendation, moved to deny the permit. <br />Dr. Tauch seconded the motion. On roll call, the following , <br />vote was recorded: <br /> <br />AYE: Cunningham, DeLa Rosa, Dibrell, Flores, King, Tauch <br />NAY: Etheredge <br /> <br />Mr. Antonio G. Acosta came before the Council to object to the <br />denial of mobile home permits to property owners. <br /> <br />The Mayor introduced a request for a permit to temporarily locate <br />a mobile home on Lot 3, Block 4 of the Wallace Addition, <br />located at 203 Laredo. Mr. DeLa Rosa moved the permit be <br />approved. Mr. Cunningham seconded the motion. Dr. Tauch <br />reminded the Council that the objections received by the <br />Planning and Zoning Commission to the location of the mobile <br />home made rejection of the permit request automatic. Mr. DeLa Rosa <br />withdrew his motion. Dr. Tauch moved the request be denied. I <br />Mr. Flores seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced an ordinance and read the caption as follows: <br /> <br />AN ORDINANCE ENTITLED "RESIDENCE HOMESTEAD EXEMPTION FOR <br />THE ELDERLY" AS AUTHORIZED BY ARTICLE VIII, SECTION l-b <br />OF THE TEXAS CONSTITUTION; PROVIDING FOR SUCH EXEMPTION; <br />EFFECTIVE DATE; APPLICATION FOR EXEMPTION, DETERMINATION <br />OF TAX ASSESSOR-COLLECTOR; LIMITATIONS OF EXEMPTION; <br />DETERMINATIVE DATE FOR EXEMPTION; AND DECLARING AN EMERGENCY. <br />
