On roll call, the following <br />vote was recorded: <br /> <br />AYE: Cunningham, DeLa Rosa, Dibrell, Etheredge, Flores, <br />King, Tauch <br /> <br />NAY: None <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />I <br /> <br />The Mayor introduced an ordinance and read the caption as follows: <br /> <br />AN ORDINANCE REPEALING THAT ORDINANCE OF NOVEMBER 9, 1970, <br />AND OF RECORD IN VOLUME 39, PAGE 42, OF THE MINUTES OF THE <br />CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, WHICH <br />DECLARED AND DETERMINED THE NECESSITY FOR THE IMPROVEMENT <br />OF CERTAIN STREETS WITHIN THE CITY LIMITS, APPROVED PLANS <br />AND SPECIFICATIONS FOR THE CONSTRUCTION OF SUCH IMPROVEMENTS, <br />AND RETAINED A FISCAL AGENT, SPECIAL COUNSEL AND CONSULTING <br />ENGINEER; DECLARING AN EMERGENCY AND PROVIDING THAT THIS <br />ORDINANCE SHALL TAKE EFFECT IMMEDIATELY UPON ITS PASSAGE. <br /> <br />Mr. King moved the Ordinance be approved as an emergency. <br />Mr. Flores seconded the motion. On roll call, the following <br />vote was recorded: <br /> <br />AYE: Cunningham, DeLa Rosa, Dibrell, Etheredge, Flores, <br />King, Tauch <br /> <br />NAY: None <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />The Mayor introduced an ordinance and read the caption as follows: <br /> <br />I <br /> <br />AN ORDINANCE DECLARING AND DETERMINING THE NECESSITY <br />FOR THE IMPROVEMENT AND ORDERING THE IMPROVEMENT OF <br />CERTAIN STREETS AND AVENUES OR PORTIONS THEREOF OF <br />THE CITY OF SAN MARCOS, TEXAS; APPROVING PLANS AND <br />SPECIFICATIONS FOR SUCH WORK; AUTHORIZING THE CITY MANAGER <br />TO ADVERTISE FOR BIDS FOR SUCH IMPROVEMENT WORK; <br />DIRECTING THE PREPARATION OF ENGINEERING ESTIMATES AND <br />THE CREATION OF AN ASSESSMENT ROLL AND CERTIFICATES OF <br />ASSESSMENT, IN THE MANNER TO THE EXTENT AND WITHIN THE <br />LIMITS HEREIN SET OUT; INVOKING THE POWERS AND THE <br />PROCEDURE PROVIDED BY CHAPTER 106 OF THE ACTS OF THE <br />FIRST CALLED SESSION OF THE 49TH LEGISLATURE OF THE STATE <br />OF TEXAS, AS AMENDED, KNOWN AS ARTICLE 1105b, VERNON'S <br />REVISED CIVIL STATUTES OF TEXAS; PROVIDING THE MANNER IN <br />WHICH AND BY WHOM THE COST OF SUCH IMPROVEMENTS SHALL BE <br />PAID AND PROVIDING FOR THE ASSESSMENT OF A PORTION OF SUCH <br />COST AGAINST ABUTTING PROPERTIES AND THE OWNERS THEREOF; <br />PROVIDING THAT THE AMOUNTS PAYABLE BY THE ABUTTING PROPERTY <br />OWNERS SHALL BE A PERSONAL LIABILITY SECURED BY A FIRST AND <br />PRIOR LEIN UPON SUCH PROPERTIES, AS WELL AS PROVIDING FOR THE <br />TERMS OF PAYMENT OF SUCH ASSESSMENTS; PROVIDING FOR A <br />SEPARABILITY CLAUSE; DIRECTING THE CITY SECRETARY TO <br />PREPARE AND FILE A NOTICE OF THE ENACTMENT HEREOF WITH THE <br />COUNTY CLERK OF HAYS COUNTY, TEXAS; DECLARING AN EMERGENCY <br />AND PROVIDING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY <br />UPON ITS PASSAGE. <br /> <br />I <br /> <br />Mr. King moved the Ordinance be passed as an emergency. <br />Dr. Tauch seconded the motion.
