<br />regular meeting, july 9, 1973 <br /> <br />page five <br /> <br />Jlh <br /> <br />The Mayor declared the Public Hearing closed and read the <br />caption of an ordinance as follows: <br /> <br />I <br /> <br />AN ORDINANCE CLOSING THE HEARING GIVEN TO'THE REAL AND <br />TRUE OWNERS OF PROPERTY ABUTTING UPON LINDA DRIVE AND <br />THORP LANE IN THE CITY OF SAN MARCOS, TEXAS, WITHIN THE <br />liMITS HEREINAFTER DEFINED, AS TO SPECIAL BENEFITS TO <br />ACCRUE TO SAID PROPERTY AND THE REAL AND TRUE OWNERS <br />THEREOF BY VIRTUE OF THE IMPROVEMENT OF SAID STREETS <br />WITHIN SAID LIMITS, AND AS TO ANY ERRORS, INVALIDITIES <br />OR IRREGULARITIES IN ANY OF THE PROCEEDINGS OR CONTRACT <br />THEREFOR; OVERRULING AND DENYING ALL PROTESTS AND <br />OBJECTIONS OFFERED; FINDING AND DETERMINING THAT EACH <br />AND EVERY PARCEL OF PROPERTY ABUTTING UPON SAID STREETS <br />WITHIN ~HE LIMITS DEFINED WILL BE SPEC1ALLY BENEFITTED <br />AND ENHANCED IN VALUE IN EXCESS OF THE AMOUNT OF THE COST <br />OF SAID IMPROVEMENTS PROPOSED TO BE, AND AS, ASSESSED <br />AGAINST SAID PROPERTY, AND THE REAl AND TRUE OWNERS <br />THEREOF, AND LEVY.I NG AN, ASSESSMENT .FOR .HIE pAYMENT OF A <br />PORTION OF THE COST OF IMPROVING SAJDSTREE~S WITHIN <br />SAID LIMITS DEFINED: FIXING A CHARGE AND LIEN AGAINST <br />SAID PROPERTIES, AND THE REAL AND TRUE OWNERS THEREOF; <br />PROVIDING FOR THE MANNER AND METHOD OF COLLECTION OF <br />SAID ASSESSMENTS; DECLARING AN EMERGENCY, AND PROVIDING <br />THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY <br />UPON ITS pASSAGE. <br /> <br />I <br /> <br />Mr. King mbved the Ordinance be Passed, Approved and Adopted <br />on an emergency basis, Dr. Tauch seconded the motion. Mr. Flores <br />asked if the plans were not in compl iance with the ordinance <br />requiring "thoroughfares" to be constructed meeting minimum <br />width dimensions, Mr. Baugh explained that the term "thoroughfares" <br />had been used as a colloquialism and was misleading. He explained <br />that the streets planned in the assessment program were actually <br />"col lector streets" and did meet the requirements of the ordinance. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Cunningham, DeLa Rosa, Dibrell, Etheredge, Flores, <br />King, Tauch <br /> <br />NA Y: None <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />Mr. Ted Breihan came before the Council to request improvements <br />be made in the pedrestian paths for children walking to and from <br />schools, and that LCRA be encouraged to replace inoperative street <br />lights. <br /> <br />Mr, Baugh reported that plans for cleaning Purgatory Creet beginning <br />July 9 had been postponed for two weeks due to the rains. <br /> <br />Mrs. Shirley Wickersham came before the Counci I to request that <br />street I ights be placed in the Fairlawn Addition. <br /> <br />I <br /> <br />The meeting adjourned at 10:00 p.m. <br /> <br />ATTEST: <br /> <br />fJ~LLZ <br /> <br />Dor i ss Hambr i ck <br />City Secretary <br /> <br />d~J l/?~ - ) . <br />~~'ithered~ <br /> <br />Mayor <br />
