13/J REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AUGUST 13, 1973 Present: Mayor Eddy A. Etheredge Councilmen William L. Cunningham Guillermo DeLa Rosa Bill Dibrell Luciano H. Flores Ross King David R. Tauch I City Manager City Secretary James B. Baugh Doriss Hambrick Also present: Jon Sparks; Diane Elder; James McCrocklin; Doyle A. Buffington; Mr. & Mrs. Pat H. Norwood; Lynn H. Tulloch; Curtis L. Jenkins; Charles J. Suckle; Geneva Gomez; Frances Emery; Jerri Martin; Derek Aldridge; Melissa Millecam; Juan Palomo; Bob Elder; The Mayor called the meeting to order at 7:30 p.m. The Minutes of the July 23 Regular Meeting were approved on motion of Mr. Flores and second of Dr. Tauch, with Mr. King abstaining. I The Mayor reported that the Executive Session of July 30 had been to canvass the applications for City Manager; and that James B. Baugh had been hired as City Manager at the Executive Session of August 6. He further reported that the position of Municipal Court Judge had been discussed at the August 13 Executive Session and that the Council was presently accepting applications for the position to be filled at the end of the regular term on October 1. Mr. Etheredge said the appointment would probably be made at the second regular meeting in Se~tember. The Mayor opened a Public Hearing to consider a change in zoning of Lots 110, 111, 115 and 116 of the Park Addition from "D" to "C". James H. McCrocklin, applicant, was present to request the change. Mr. Curtis Jenkins and Dr. Pat Norwood were present to object to the change, stating that they wished the area to remain a residential area. The Mayor closed the public hearing and read the caption of an ordinance as follows: AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23,)966 (VOL. 32) BY CHANGING THE ZONING OF LOTS 110, 111, ~lliND 116 OF THE PARK ADDITION, FROM "D" (MULTIFAMILY) TO "c" (COMMERCIAL). Mr. King, noting the Planning and Zoning reconnnendation for"approval, moved the Ordinance by approved on first reading. Dr. Tauch seconded the motion, and on roll call the following vote was recorded: AYE: Cunningham, DeLa Rosa, Dibrell, Etheredge, King, Tauch NAY: None ABSTAIN: Flores I The Mayor declared the motion passed and the Ordinance approved on first reading. The Mayor opened a Public Hearing to consider a request for a change in zoning of Lots 112 and 113 in the Park Addition, located at 828 Chestnut Street, from "R-I" to "C". Robert Elder, applicant, was present to request the change. Mr. Curtis and Dr. Norwood again stated their objections. Dr. Norwood reminded the Council that the Planning and Zoning Connnission had reconnnended denial of the request. The Mayor closed the Public Hearing and read the caption of an ordinance as follows:
