<br />55 <br /> <br />regular meeting, december 27, 1972 <br /> <br />page two <br /> <br />AN ORDINANCE AMENDING APPENDIX "A" OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, <br />ENTITLED "GENERAL ZONING ORDINANCE", BY THE DELETION <br />OF SUB-SECTION 3 OF SECTION 13 AND THE SUBSTITUTION <br />THEREOF OF A NEW SUB-SECTION 3 OF SECTION 13 PROVIDING <br />FOR AN EXCEPTION PROHIBITING ESTABLISHMENTS WHICH <br />DISPENSE LIQUOR, WINE OR BEER FOR ON-PREMISE CON- <br />SUMPTION UNDER PERMIT BY THE STATE OF TEXAS WITHIN <br />A COMMERCIAL DISTRICT "CUi AND BY THE AMENDMENT OF <br />SUB-SECTION 1 OF SECTION 13.1 ENTITILED COMMERCIAL <br />DISTi~ICT "C-2", <br /> <br />I <br /> <br />Councilman King moved the ordinance be approved on first <br />reading. Dr. Tauch seconded the motion. On rol I cal I, the <br />following vote was recorded: <br /> <br />AYE: <br /> <br />Cunningham, DeLa Rosa, Flores, King, Tauch, <br />Yarbrough <br /> <br />NAY: <br />ABSTAIN: <br /> <br />None <br />Ethe redge <br /> <br />The Mayor declared the ordinance approved on first reading. <br /> <br />Ed Tarbutton, III, came before the Council to request approval <br />of a bill iard hall permit for a business to be located at <br />127 E. Hopkins. Mr. King moved to deny the permit. Dr. Tauch <br />seconded the motion. Mr. King stated that he felt the location <br />inappropriate for the type of business, especially ~ince the <br />owners would probably wish to acquire an alcohol ic beverage <br />license. Mr. Tarbutton and his partner~ Mr. John Love, assured <br />the Council that the establishment would be properly managed <br />so as not to be a nuisance to other persons having business <br />in that area. Counci Imen discussed the matter at length. I <br />Mr. King called for question. On rol I cal I, the fol lowing <br />vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />DeLa Rosa, Cunningham, King <br />Etheredge, Flores, Tauch, Yarbrough <br /> <br />The Mayor declared the motion defeated. <br /> <br />Mr. Etheredge moved to approve the permit. Dr, Tauch seconded <br />the motion. On roll call, the fol lowing vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Etheredge, Flores, Tauch, Yarbrough <br />DeLa Rosa, Cunningham, King <br /> <br />The Mayor declared the motion passed. <br /> <br />County Commissioner-elect, Ruben Ruiz came before the Council to <br />personally submit his resignation from the Housing Authority. <br />He thanked the Council for allowing him to serve the community. <br />Mr. Ruiz assured the Council that they would have a friend in <br />Commissioner's Court, and stated that he hoped to see more city- <br />county cooperation. <br /> <br />Councilman Yarbrough requested a progress report on the sutdy <br />being made of the traffic hazard at the intersection of Broadway <br />and Highway 123. The City Manager reported that an off-duty <br />patrolman has been assigned to cover the intersection during <br />school hours until a more permanent solution can be found. <br /> <br />I <br />
