55 regular meeting, december 27, 1972 page two AN ORDINANCE AMENDING APPENDIX "A" OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED "GENERAL ZONING ORDINANCE", BY THE DELETION OF SUB-SECTION 3 OF SECTION 13 AND THE SUBSTITUTION THEREOF OF A NEW SUB-SECTION 3 OF SECTION 13 PROVIDING FOR AN EXCEPTION PROHIBITING ESTABLISHMENTS WHICH DISPENSE LIQUOR, WINE OR BEER FOR ON-PREMISE CON- SUMPTION UNDER PERMIT BY THE STATE OF TEXAS WITHIN A COMMERCIAL DISTRICT "CUi AND BY THE AMENDMENT OF SUB-SECTION 1 OF SECTION 13.1 ENTITILED COMMERCIAL DISTi~ICT "C-2", I Councilman King moved the ordinance be approved on first reading. Dr. Tauch seconded the motion. On rol I cal I, the following vote was recorded: AYE: Cunningham, DeLa Rosa, Flores, King, Tauch, Yarbrough NAY: ABSTAIN: None Ethe redge The Mayor declared the ordinance approved on first reading. Ed Tarbutton, III, came before the Council to request approval of a bill iard hall permit for a business to be located at 127 E. Hopkins. Mr. King moved to deny the permit. Dr. Tauch seconded the motion. Mr. King stated that he felt the location inappropriate for the type of business, especially ~ince the owners would probably wish to acquire an alcohol ic beverage license. Mr. Tarbutton and his partner~ Mr. John Love, assured the Council that the establishment would be properly managed so as not to be a nuisance to other persons having business in that area. Counci Imen discussed the matter at length. I Mr. King called for question. On rol I cal I, the fol lowing vote was recorded: AYE: NAY: DeLa Rosa, Cunningham, King Etheredge, Flores, Tauch, Yarbrough The Mayor declared the motion defeated. Mr. Etheredge moved to approve the permit. Dr, Tauch seconded the motion. On roll call, the fol lowing vote was recorded: AYE: NAY: Etheredge, Flores, Tauch, Yarbrough DeLa Rosa, Cunningham, King The Mayor declared the motion passed. County Commissioner-elect, Ruben Ruiz came before the Council to personally submit his resignation from the Housing Authority. He thanked the Council for allowing him to serve the community. Mr. Ruiz assured the Council that they would have a friend in Commissioner's Court, and stated that he hoped to see more city- county cooperation. Councilman Yarbrough requested a progress report on the sutdy being made of the traffic hazard at the intersection of Broadway and Highway 123. The City Manager reported that an off-duty patrolman has been assigned to cover the intersection during school hours until a more permanent solution can be found. I
