<br />51 <br /> <br />regular meeting, january 8, 1973 <br /> <br />page two <br /> <br />The Mayor introduced an appl ication to vacate a plat for <br />3herilyn Estates (see attached letter and appl ication). <br />Mr. Lee Caldwell explained the absence of Russel I C. Ayers <br />signature on the appl ication, stating that Mr. Ayers would <br />be in the city in the next few days to sign. Councilman King <br />moved the appl ication to vacate the plat be approved. Dr. Tauch <br />seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced Mr. Kenneth Finch of Ernst and Ernst, <br />auditors for the City. Mr. Finch summarized the results of <br />the audit for the City's 1971-1972 fiscal year (see letter <br />attached). Various items were discussed by Mr. Finch and <br />the Counci I. Mr. YarbrQugh moved to accept the annual audit. <br />Mr. Etheredge seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />The Mayor introduced an ordinance and the Deputy City Secretary <br />read the caption as follows: <br /> <br />AN nRDINANCE AMENDING APPENDIX "A" OF THE CODE OF <br />ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED <br />"GENE~AL ZONING ORDINANCE", BY THE DELETION OF SUB- <br />SECTION 3 OF SECTION 13 AND THE SUBSTITUTION THEREOF <br />OF A NEW SUB-SECTION 3 OF SECTION f3 PROVIDING FOR <br />AN EXCEPTION PROHIBITING ESTABLISHMENTS WnlCH DISPENSE <br />LI QUOR, WINE OR BEER FOR ON-PREM I SE CONSUMPT I ON UNDER <br />PERMIT 'BY THE STAn: OF TEXAS WITHIN A COMMERCIAL DISnlCT <br />"C"; AND BY THE AMENDMENT OF SUB-SECTION 1 OF SECTION <br />13.1 ENTITLED COMMERCIAL DIST~ICT "C-2". <br /> <br />Dr. Tauch moved the ordinance be approved on second reading. <br />Mr. Cunningham seconded the motion, which passed unanimously. <br />The Mayor declared the ordinance approved on second reading_ <br /> <br />Councilman DeLa Rosa nominated the Reverned David Chavez to <br />fi I I the vacancy on the Housing Authority, and moved his <br />appointment. Mr. Etheredge seconded the motion, which passed <br />unanim'Ously., <br /> <br />I <br /> <br />Councilman Tauch nominated Mr. W.C. Carson to fil I the vacancy <br />on the Zoning Board of Adjustment and Appeals, and moved his <br />appointment. Mr. Etheredge seconded the motion, which passed <br />unanaimously. <br /> <br />Mr. Etheredge nominated Mrs. Frances Emery for the Senior <br />Citizens Advisory Board. <br /> <br />Dr. Tauch suggested that the press be notified of vacancies on <br />City boards and committees, and the publ ic be encouraged to <br />volunteer to serve. <br /> <br />Mayor Flores reported that the compilation of job descriptions <br />for the Municipal Court Judge and Municipal Court Clerk had <br />been discussed in the Executive Session held fol lowing the <br />regular meeting on December 27, and that no action had been taken. <br /> <br />Councilman DeLa Rosa observed that certain streets crossing I <br />main thoroughfares in the city had trees close to intersections <br />creating traffic hazards for persons entering those inter- <br />sections. The City Manager stated that the City was expanding <br />its program of alleviating those hazards. <br /> <br />Mr. H.Y. Price, jr., of the 3an Marcos Telephone Company, came <br />before the Council to explain his decision to increase telephone <br />rates for the "392" exchange, effect i ve February 1. Schedu ling <br />of the ordinance increasing the rates was discussed by Councilmen <br />and Mr. Price. <br />
