On roll call, the following vote was recorded: <br /> <br />AYE: <br />NAY: <br />ABSTAIN: <br /> <br />Cunningham, Etheredge, King, Tauch <br />DeLa Rosa, Dibrell <br />Flores <br /> <br />The Mayor declared the request for a rezoning denied since a three- <br />fourths majority vote is required by law to approve a zoning change <br />when 20% of adjacent property owners are in objection to the change. <br /> <br />Mayor Etheredge opened a Public Hearing to consider a request for I <br />a change in zoning of Lots 8 and 9, Block 19 of the Original Town of <br />San Marcos, located at 312 Comal Street, from "c" to "C-2". Attorney <br />Dwain Blaschke, representing Anselmo N. Gonzales, applicant, informed <br />the Council that Mr. Gonzales did not wish to serve alcoholic beverages <br />for on premises consumption at this location, but that he did wish to <br />obtain a license for that purpose at another location. Since Mr. Gonzales <br />could apply for only one type of license, he was requesting that three <br />pieces of property be rezoned. The Mayor informed Mr. Blaschke that he <br />was under the impression that the law had been changed to allow persons <br />to hold more than one type of license. Mr. Blaschke then requested that <br />the request for rezoning on Agenda Items 6 and 8 be tabled until he <br />could obtain necessary information from the Alcoholic Beverage Commission. <br />Mr. Etheredge declared the Public Hearing closed. <br /> <br />Mr. DeLa Rosa moved to table Agenda Items 6 and 8. Mr. Cunningham seconded <br />the motion which passed unanimously. <br /> <br />The Mayor opened a Public Hearing to consider a request for a change in <br />zoning of all of Lot 25 and part of Lots 23 and 24 of the Charles Meiners <br />Subdivision, located on Loop 82 North, from "c" to "C-2". Dwain Blaschke <br />was present to represent the applicant, Anselmo Gonzales. JoAnn Childress, <br />Rena Deck, Mike Brasher, C.E. O'Bryant (who stated that he owned a portion <br />of Lot 25 in question), Mr. Edmond Lyon and Elmer Satterwhite came before <br />the Council to object to the rezoning. The Mayor also read a letter from <br />Mr. Charles Zunker opposing the change. All were adjacent property owners. I <br />The Mayor closed the Public Hearing and read the caption of an ordinance <br />as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF ALL <br />OF LOT 25 AND PART OF LOTS 23 AND 24 OF THE CHARLES MEINERS SUB- <br />DIVISION, LOCATED ON LOOP 82 NORTH, FROM "c" (COMMERCIAL) TO "C-2" <br />(COMMERCIAL). <br /> <br />Mr. King moved the Ordinance not be approved. Mr. Dibrell seconded the <br />motion. On roll call, the following vote was recorded: <br /> <br />AYE: Dibrell, Flores, King, Tauch <br />NAY, Cunningham, DeLa Rosa; Etheredge <br /> <br />The Mayor declared the motion passed and the Ordinance not approved, <br /> <br />Mayor Etheredge opened a Public Hearing to consider a request for a <br />change in zoning of part of Lots 8 and 9, Original Town of San Marcos, <br />located at 153 SouthL.B.J. Drive, from "C" to "C-2". There was no one <br />present to request or object to the rezoning. The Mayor closed the <br />pub lic hearing. <br /> <br />Mr. Flores moved to table the request until the applicant was present. <br />Mr. King seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />The Mayor introduced an ordinance authorizing the disbursement of <br />Certificates of Obligation for claims incurred in the construction of <br />the Police and Courts Building, which he read in full. Mr. King moved <br />the Ordinance be Passed, Approved and Adopted as an emergency. <br />Mr.. DeLa Rosa seconded the motion.
