12 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, OCTOBER 23,1973 Present: Mayor Eddy A. Etheredge Councilmen William L. Cunningham Guillermo DeLa Rosa Bill Dibrell Luciano H. Flores Ross King David R. Tauch I City Manager City Attorney City Secretary James B. Baugh Tom Akins Doriss Hambrick Also present: Jon Sparks; Emmett Shelton; S.L. Box; Frances Emery; Jerry Hinnenkamp The Mayor called the meeting to order at 7:30 p.m. The Minutes of the Regular Meeting held October 8,1973 were approved on motion of Councilman DeLa Rosa and second of Councilman King. The Minutes of the Special Meeting held October 15, 1973, were approved on motion of Councilman DeLa Rosa and second of Councilman King. The Mayor opened a Public Hearing to consider a request for a change in zoning of 1.1 acres, more or less, out of the J.M. Veramendi League No.2, from ItC" to "C-2". Attorney Emmett Shelton was present to represent the applicant, William L. Nolen. No objections were voiced. The Mayor closed the Public Hearing and read the caption of an ordinance as follows: I AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 1.1 ACRES, MORE OR LESS, OUT OF THE J.M. VERAMENDI LEAGUE NO. 2,LOCATED AT THE SOUTHWEST CORNER OF THE INTERSECTION OF UHLAND ROAD WITH HIGHWAY NO. 35, FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL). Mr. Dibrell moved the Ordinance be approved on first reading. Dr. Tauch seconded the motion which passed unanimously. Mayor Etheredge read the caption of an ordinance as follows: I AN ORDINANCE CLOSING AND ABANDONING AN ALLEY WHICH IS PART OF THE PARK ADDITION TO THE CITY OF SAN MARCOS, TEXAS, NAMELY THAT ALLEY BOUNDED BY PEACH TREE STREET AND LOTS NUMBER 67 AND 66 OF SAID ADDITION; RELINQUISHING TO STEPHEN L. BOX AND BARNETT BAKER, ALL RIGHT, TITLE AND INTEREST OF THE CITY OF SAN MARCOS IN AND TO SAID ALLEY; AND DIRECTING THE MAYOR OF SAID CITY TO EXECUTE AND DELIVER TO SUCH PERSONS QUITCLAIM DEEDS TO PORTIONS OF SAID ALLEY. Mr. DeLa Rosa moved the Ordinance be approved on first reading. Mr. King seconded the motion which passed unanimously. Mayor Etheredge introduced for consideration an ordinance changing the zoning of property located at 153 South L.B.J. Drive, As the applicant was not present, no action was taken.
