17 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOVEMBER 12, 1973 Present: Mayor Eddy A. Etheredge Councilmen William L. Cunningham Guillermo DeLa Rosa Bill Dibrell Luciano H. Flores Ross King I City Manager City Attorney City Secretary James B. Baugh Tom Akins Doriss Hambrick Absent: Councilman David R. Tauch Also present: Bill Jonas; Deborah A. Hemperly; James P. Gaffey; Robert Champion; Richard Vivas; Donna Throckmorton; Frances Marshall; Geneva Gomez; Stanley L. Sissom; Shirley Wickersham The Mayor called the meeting to order at 7:30 p.m. The Minutes of the Regular Meeting held October 23, 1973, were approved on motion of Councilman DeLa Rosa and second of Councilman Cunningham. The Mayor opened a public hearing to consider a request for a change in zoning of part of Lot 5, Block 5 of the Dan McKie Second Addition. Bill Jonas, applicant, was present to request the change. There were no objections received. The Mayor closed the public hearing and read the caption of an ordinance as follows: I AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART OF LOT 5, BLOCK 5 OF THE DAN McKIE SECOND ADDITION, LOCATED ON THE CORNER OF CHEATHAM AND GUADALUPE STREETS, FROM "C" (COMMERCIAL) TO "C-2'/ (COMMERCIAL). Mr. DeLa Rosa moved the Ordinance be approved on first reading. Mr. King seconded the motion which passed unanimously. Mr. King moved an ordinance amending the General Zoning Ordinance by changing the zoning of part of Lots 8 and 9, Block 9 of the Original Town of San Marcos from "C" to "C-2" be taken from the table for discussion. Mr. Cunningham seconded the motion which passed unanimously. Donna Throckmorton was present to represent the record owner of the property, W.H. Hamilton. The City Attorney advised the Council that the application for rezoning, designating Jackie L. Bruton as applicant and signed by W.H. Hamilton, was in order. The Mayor read the caption of the Ordinance as follows: I AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART OF LOTS 8 AND 9, BLOCK 9 OF THE ORIGINAL TOWN OF SAN MARCOS, LOCATED AT 153 SOUTH L.B.J. DRIVE, FROM "C" (COMMERCIAL) TO "C-2" (COMMERCIAL). Mr. King moved the Ordinance be approved on first reading. Mr. Cunningham seconded the motion. Councilmen discussed their concern with regard to the indefinite planned usage of the property. On roll call, the following vote was recorded: AYE: Cunningham, Etheredge, King NAY: DeLa Rosa, Dibrell, Flores The Mayor declared the motion failed and the ordinance not approved.
