<br />18 <br /> <br />regular meeting, november 12, 1973 <br /> <br />page two <br /> <br />Mayor Etheredge read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE 5 <br />(TRAFFIC CONTROL DEVIeES) OF CHAPTER 29 OF THE CODE OF THE CITY <br />OF SAN MARCOS, TEXAS BY ADDING A PROHIBITION AGAINST RIGHT TURNS <br />ON RED AT THE INTERSECTION OF SOUTH L.B.J. DRIVE AND SAN ANTONIO <br />STREET AND AT THE INTERSECTION OF NORTH L.B.J. DRIVE AND COLORADO <br />STREET WITHIN THE CORPORATE LIMITS OF THE CITY OF SAN MARCOS; <br />PROVIDING FOR A PENALTY; AND DECLARING AN EMERGENCY. <br /> <br />Mr. DeLa Rosa moved the Ordinance be approved as an emergency. Mr. Dibrell <br />seCOnded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: Cunningham, DeLa Rosa, Dibrell, Etheredge, Flores, King <br />NAY: None <br /> <br />I <br /> <br />The Mayor declared the Ordinance Passed, Approved and Adopted. <br /> <br />Mr. DeLa Rosa moved the renewal of a temporary permit requested by Manuel <br />Vargas for a mobile home located on Lot 2, Block 2 of the Dan McKie <br />Addition, 805 Gravel Street. Mr. Cunningham seconded the motion which <br />passed unanimously. <br /> <br />The Mayor introduced a request by Henry Guerra for a temporary permit to <br />place a mobile home on Lot 35, Block 1 of the J.M. Stone Addition, located <br />at the corner of Faris and Mitchell streets. It was noted that objections <br />from two adjacent property owners had been received, and that the Planning <br />and Zoning Commission had recommended denial of the request. Mr. King <br />moved denial of the permit. Mr. Dibrell seconded the motion. On roll <br />call, the following vote was recorded: <br /> <br />AYE: DeLa Rosa, Dibrell, Etheredge, Flores, King <br />NAY: Cunningham <br /> <br />Mr. Etheredge read the caption of a Resolution as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />AUTHORIZING THE CITY. ATTORNEY TO PREPARE AND THE CITY MANAGER TO <br />EXECUTE CERTAIN RESTRICTIVE COVENANTS TO BE ADDED TO A CERTAIN <br />WARRANTY DEED DATED NOVEMBER 6, 1973, WHEREBY THE URBAN RENEWAL <br />AGENCY OF THE CITY OF SAN MARCOS CONVEYED UNTO THE CITY OF SAN MARCOS <br />A CERTAIN TRACT OF LAND TO BE USED FOR SWIMMING POOL PURPOSES. <br /> <br />I <br /> <br />Mr. King moved the Resolution be Passed and Approved. Mr. DeLa Rosa seconded <br />the motion which passed unanimously. <br /> <br />Mr. King moved approval of authorization of the Mayor to execute an easement <br />with the San Marcos Telephone Company (see attached) for the placement of <br />a direct burial cable across City property. Mr. Cunningham seconded the <br />motion which passed with five votes in favor and Mayor Etheredge abstaining. <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES:AND LAND, <br />DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 1.1 ACRES, MORE <br />OR LESS, OUT OF THE J.M. VERAMENDI LEAGUE NO.2, LOCATED AT THE SOUTH- <br />WEST CORNER OF THE INTERSECTION OF UHLAND ROAD WITH HIGHWAY NO. 35, <br />FROM "C" (COMMERCIAL) TO "C~2" (COMMERCIAL). <br /> <br />Mr. DeLa Rosa moved approval of the Ordinance on second reading. Mr. King <br />seconded the motion which passed unanimously. <br /> <br />I <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE CLOSING AND ABANDONING AN ALLEY WHICH IS PART OF THE PARK <br />ADDITION TO THE CITY OF SAN MARCOS, TEXAS, NAMELY THAT ALLEY BOUNDED <br />BY PEACH TREE STREET AND LOTS NUMBER 67 AND 68 OF SAID ADDITION; RELIN- <br />QUISHING TO STEPHEN L. BOX AND BARNETT BAKER, ALL RIGHT, TITLE AND INTEREST <br />OF THE CITY OF SAN MARCOS IN AND TO SAID ALLEY; AND DIRECTING THE MAYOR <br />OF SAID CITY TO EXECUTE AND DELIVER TO SUCH PERSONS QUITCLAIM DEEDS TO <br />PORTIONS OF SAID ALLEY. <br />
