68 RESOLUTION NO. 1974-2-R I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING A CONTRACT BETWEEN THE CITY OF SAN MARCOS AND THE TEXAS HIGHWAY DEPARTMENT FOR THE PERMITTING AND MAINTENANCE OF A TEN INCH (IOn) WATER LINE CROSSING THE SAN MARCOS RIVER AT THE LOOP 82 BRIDGE OF SAID RIVER; AND AUTHORIZING THE CITY MANAGER OF SAID CITY TO EXECUTE THE SAME. WHEREAS, the City Council of the City of San Marcos, Texas, is advised that the Loop 82 bridge will be widened pursuant to the development of Loop 82; and, WHEREAS, the City Council desires to affix the City's ten inch (IOn) water line crossing the San Marcos River at that point to said bridge; and, WHEREAS, the City Council of the City of San Marcos, Texas, desires to enter into agreement with the Texas Highway Department for the permitting and maintenance of a ten inch (IOn) water line across the San Marcos River at the Loop 82 bridge within said City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: Part 1. That the City of San Marcos enter into agreement with the Texas Highway Department providing for the permitting and maintenance of a ten inch (IOn) water line crossing the San Marcos River at the Loop 82 bridge of said River, within the corporate limits of said City. Part 2. That the agreement between the City and the Texas Highway Department be, and is hereby, in all things approved. I Part 3. That Mr. James B. Baugh, City Manager of said City, or his successor, be, and is hereby, authorized to execute said agreement and such other action necessary to effectuate the foregoing considerations. Part 4. That this Resolution take effect immediately from and after the date of passage.
