<br />83 <br /> <br />regular meeting, february 25, 1974 <br /> <br />page two <br /> <br />Mayor Etheredge announced his resignation as Councilman, effective <br />when his successor has been elected and qualified, as required by <br />Article XI, Section 11 of the State Constitution; a measure made <br />necessary by Mr. Etheredge's candicacy for County Judge. The Mayor <br />then read the caption of an ordinance as fo11ows: <br /> <br />AN ORDINANCE AMENDING THE ORDER CALLING FOR THE REGULAR CITY <br />ELECTION BY PROVIDING FOR THE ELECTION OF COUNCILMAN, PLACE 5. <br /> <br />Councilmen were informed that, although the ordinance had not appeared <br />on the agenda, a notice that it would be considered had been posted more <br />than two hours prior to the meeting and the press informed. Councilman <br />DeLa Rosa challenged acting upon the measure since the Council had <br />not received prior notification. Mr. Dibrell moved the Ordinance be <br />approved as an emergency. Dr. Tauch seconded the motion. On roll call, <br />the following vote was recorded: <br /> <br />I <br /> <br />AYE: Cunningham, Dibrell, Etheredge, Flores, Tauch <br />NAY: DeLa Rosa <br /> <br />Mr. Etheredge read the caption of an ordinance to be considered in <br />conjunction with the one described above: <br /> <br />AN ORDINANCE AMENDING THE ORDER AND RESOLUTION ESTABLISHING <br />PROCEDURE FOR THE REGULAR CITY ELECTION BY PROVIDING FOR THE <br />ELECTION OF COUNCILMAN, PLACE 5. <br /> <br />Mr. Dibrell moved the Ordinance be approved as an emergency. Mr. Cunningham <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: Cunningham, Dibrell, Etheredge, Flores, Tauch <br />NAY: DeLa Rosa <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE AMENDING APPENDIX A, GENERAL ZONING ORDINANCE OF I <br />THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY THE <br />ADDITION TO SECTION 4, ENTITLED "DEFINITIONS", FOR A "MOBILE <br />HOME PARK" AND A "MOBILE HOME"; ALSO AMENDING SECTION 5.A. OF <br />SAID APPENDIX ENTITLED "DISTRICTS DESIGNATED" BY ADDING THE <br />DESIGNATION OF "MHP" FOR MOBILE HOME PARKS; BY DELETING SECTION 15.1 <br />OF SAID APPENDIX ENTITLED "TEMPORARY USE OF LAND BY TRAILER HOUSES" <br />AND SUBSTITUTING AN ENTIRELY NEW SECTION UNDER THE SAME NUMBER <br />ENTITLED "MOBILE HOME"; ESTABLISHING A SECTION 15.2 OF SAID <br />APPENDIX ENTITLED "TEMPORARY USE OF LAND BY MOBILE HOMES.; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. DeLa Rosa moved the Ordinance be approved on second reading. Mr. Dibrell <br />seconded the motion, which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER FIVE OF THE CODE OF ORDINANCES OF THE CITY OF <br />SAN MARCOS BY ADDING SECTION 5-29 (1) REQUIRING BUILDING PERMITS <br />FOR SWIMMING POOLS AND ENCLOSURE DEVICES; (2) REQUIRING AN ENCLOSURE <br />DEVICE~AROUND AL"LDUTDDOR SWIMMING POOLS WITHIN THE CORPORATE LIMITS <br />OF SAID CITY; (3) PROVIDING FOR THE ENCLOSURE OF ALL EXISTING OUTDOOR <br />SWIMMING POOLS WITHIN TWO YEARS OF THE EFFECTIVE DATE OF THIS <br />AMENDMENT. <br /> <br />Mr. Cunningham moved the Ordinance be approved on second reading. Mr. DeLa Rosa I <br />seconded the motion. Present were apartment owners~ motel owners and owners <br />of private swimming pools to protest the passage of this ordinance. <br />Mr. Dibrell suggested the deletion of the retroactive clause requiring all present <br />pools owners to comply. Councilmen discussed the ordinance. Mr. Dibrell <br />moved the ordinance be tabled. Mr. Flores seconded the motion. On roll <br />call, the following vote was recorded: <br /> <br />AYE: DeLa Rosa, Dibrell, Flores, Tauch <br />NAY: Cunningham, Etheredge <br /> <br />Councilmen requested the matter be placed on the March 4 workshop agenda. <br />
