83 regular meeting, february 25, 1974 page two Mayor Etheredge announced his resignation as Councilman, effective when his successor has been elected and qualified, as required by Article XI, Section 11 of the State Constitution; a measure made necessary by Mr. Etheredge's candicacy for County Judge. The Mayor then read the caption of an ordinance as fo11ows: AN ORDINANCE AMENDING THE ORDER CALLING FOR THE REGULAR CITY ELECTION BY PROVIDING FOR THE ELECTION OF COUNCILMAN, PLACE 5. Councilmen were informed that, although the ordinance had not appeared on the agenda, a notice that it would be considered had been posted more than two hours prior to the meeting and the press informed. Councilman DeLa Rosa challenged acting upon the measure since the Council had not received prior notification. Mr. Dibrell moved the Ordinance be approved as an emergency. Dr. Tauch seconded the motion. On roll call, the following vote was recorded: I AYE: Cunningham, Dibrell, Etheredge, Flores, Tauch NAY: DeLa Rosa Mr. Etheredge read the caption of an ordinance to be considered in conjunction with the one described above: AN ORDINANCE AMENDING THE ORDER AND RESOLUTION ESTABLISHING PROCEDURE FOR THE REGULAR CITY ELECTION BY PROVIDING FOR THE ELECTION OF COUNCILMAN, PLACE 5. Mr. Dibrell moved the Ordinance be approved as an emergency. Mr. Cunningham seconded the motion. On roll call, the following vote was recorded: AYE: Cunningham, Dibrell, Etheredge, Flores, Tauch NAY: DeLa Rosa The Mayor read the caption of an ordinance as follows: AN ORDINANCE AMENDING APPENDIX A, GENERAL ZONING ORDINANCE OF I THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY THE ADDITION TO SECTION 4, ENTITLED "DEFINITIONS", FOR A "MOBILE HOME PARK" AND A "MOBILE HOME"; ALSO AMENDING SECTION 5.A. OF SAID APPENDIX ENTITLED "DISTRICTS DESIGNATED" BY ADDING THE DESIGNATION OF "MHP" FOR MOBILE HOME PARKS; BY DELETING SECTION 15.1 OF SAID APPENDIX ENTITLED "TEMPORARY USE OF LAND BY TRAILER HOUSES" AND SUBSTITUTING AN ENTIRELY NEW SECTION UNDER THE SAME NUMBER ENTITLED "MOBILE HOME"; ESTABLISHING A SECTION 15.2 OF SAID APPENDIX ENTITLED "TEMPORARY USE OF LAND BY MOBILE HOMES.; AND PROVIDING AN EFFECTIVE DATE. Mr. DeLa Rosa moved the Ordinance be approved on second reading. Mr. Dibrell seconded the motion, which passed unanimously. The Mayor read the caption of an ordinance as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER FIVE OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS BY ADDING SECTION 5-29 (1) REQUIRING BUILDING PERMITS FOR SWIMMING POOLS AND ENCLOSURE DEVICES; (2) REQUIRING AN ENCLOSURE DEVICE~AROUND AL"LDUTDDOR SWIMMING POOLS WITHIN THE CORPORATE LIMITS OF SAID CITY; (3) PROVIDING FOR THE ENCLOSURE OF ALL EXISTING OUTDOOR SWIMMING POOLS WITHIN TWO YEARS OF THE EFFECTIVE DATE OF THIS AMENDMENT. Mr. Cunningham moved the Ordinance be approved on second reading. Mr. DeLa Rosa I seconded the motion. Present were apartment owners~ motel owners and owners of private swimming pools to protest the passage of this ordinance. Mr. Dibrell suggested the deletion of the retroactive clause requiring all present pools owners to comply. Councilmen discussed the ordinance. Mr. Dibrell moved the ordinance be tabled. Mr. Flores seconded the motion. On roll call, the following vote was recorded: AYE: DeLa Rosa, Dibrell, Flores, Tauch NAY: Cunningham, Etheredge Councilmen requested the matter be placed on the March 4 workshop agenda.
