137 regular meeting, may 13, 1974 page five Robert Carr, attorney for Bob Guerin, J.C. Varner, J.I. Stansell and others having an interest in mobile home parks and related matters, came before the Council to request a suspension of the p~esent Mobile Home Park Ordinance, alleging that portions of the ordinance were unreasonable. By common consent of the Council, Mr. Carr was advised that his clients', objections should be referred to the City Attorney, in writing, before any action would be taken by the Council. I Mr. Ira Kennedy came before the Council to request that research be done to determine if possible pollution of Springlake and the San Marcos River was occuring due to chemicals used on the golf course. The City Manager was requested to contact the Texas Water Quality Board for an investigation of the matter. Mr. Kennedy and Mr. Russel Scott provided the Council with a list of chemicals used by the Golf Association. The Mayor introduced for consideration the matter of a hearing requested by ENTEX, Inc. (formerly United Gas, Inc.) before the Texas Railroad Commission regarding an increase in rates to compensate for increased fuel costs. The City Attorney requested the Council consider authorization to request a full hearing before the Commission or to accept an interim rate to be set by the Commission without a full hearing. Mr. Sutton moved to authorize the City Attorney to request a full hearing. Mr. Cunningham seconded the motion. On roll call, the following vote was recorded: AYE: Cunningham, Dibrell, Sutton NAY: Breihan, Craddock, Flores, Hansen Mr. Breihan moved authorization of the City Attorney to accept an interim rate established by the Commission without requesting a full hearing. Mr. Hansen seconded the motion. On roll call, the following vote was recorded: AYE: Breihan, Craddock, Flores, Hansen NAY: Cunningham, Dibrell, Sutton. I Mrs. Jack N. Stovall, Chairman of the San Marcos Bicentennial Commission, came before the Council with the quarterly report (see attached) of the Commission. Councilmen discussed appointments to various boards and committees. Mr. Dibrell suggested no action be taken until new councilmen had had time to make nominations. Mr. Dibrell moved the May 27, 1974 Regular Meeting be rescheduled for May 28, 1974. Mr. Hansen seconded the motion, which passed unanimously. Mr. Dibrell moved a recess to executive session to discuss litigation regarding the Lyndon Herring Suit. Mr. Hansen seconded the motion, which passed unanimously. When the Council reconvened, Mr. Cunningham moved not to appeal the decision of the Herring suit. Mr. Flores seconded the motion, which passed unanimously.
