<br />137 <br /> <br />regular meeting, may 13, 1974 <br /> <br />page five <br /> <br />Robert Carr, attorney for Bob Guerin, J.C. Varner, J.I. Stansell and <br />others having an interest in mobile home parks and related matters, came <br />before the Council to request a suspension of the p~esent Mobile Home Park <br />Ordinance, alleging that portions of the ordinance were unreasonable. <br />By common consent of the Council, Mr. Carr was advised that his clients', <br />objections should be referred to the City Attorney, in writing, before any <br />action would be taken by the Council. <br /> <br />I <br /> <br />Mr. Ira Kennedy came before the Council to request that research be done to <br />determine if possible pollution of Springlake and the San Marcos River was <br />occuring due to chemicals used on the golf course. The City Manager was <br />requested to contact the Texas Water Quality Board for an investigation of <br />the matter. Mr. Kennedy and Mr. Russel Scott provided the Council with a <br />list of chemicals used by the Golf Association. <br /> <br />The Mayor introduced for consideration the matter of a hearing requested by <br />ENTEX, Inc. (formerly United Gas, Inc.) before the Texas Railroad Commission <br />regarding an increase in rates to compensate for increased fuel costs. <br />The City Attorney requested the Council consider authorization to request a <br />full hearing before the Commission or to accept an interim rate to be set by <br />the Commission without a full hearing. Mr. Sutton moved to authorize the <br />City Attorney to request a full hearing. Mr. Cunningham seconded the motion. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Cunningham, Dibrell, Sutton <br />NAY: Breihan, Craddock, Flores, Hansen <br /> <br />Mr. Breihan moved authorization of the City Attorney to accept an interim rate <br />established by the Commission without requesting a full hearing. Mr. Hansen <br />seconded the motion. On roll call, the following vote was recorded: <br /> <br />AYE: Breihan, Craddock, Flores, Hansen <br />NAY: Cunningham, Dibrell, Sutton. <br /> <br />I <br /> <br />Mrs. Jack N. Stovall, Chairman of the San Marcos Bicentennial Commission, <br />came before the Council with the quarterly report (see attached) of the <br />Commission. <br /> <br />Councilmen discussed appointments to various boards and committees. Mr. Dibrell <br />suggested no action be taken until new councilmen had had time to make nominations. <br /> <br />Mr. Dibrell moved the May 27, 1974 Regular Meeting be rescheduled for May 28, <br />1974. Mr. Hansen seconded the motion, which passed unanimously. <br /> <br />Mr. Dibrell moved a recess to executive session to discuss litigation regarding <br />the Lyndon Herring Suit. Mr. Hansen seconded the motion, which passed <br />unanimously. <br /> <br />When the Council reconvened, Mr. Cunningham moved not to appeal the decision <br />of the Herring suit.
