<br />Mr. Flores amended his motion to approve the ordinance by stating in
<br />the motion the council's intention to discuss the matter at the next

<br />ADDITION TO THE CITY OF SAN MARCOS, TEXAS, TO BLUEBONNET DRIVE
<br />AND RELINQUISHING TO MARIAN NELSON MEEKS, HUGH A. NELSON, JR.,
<br />AND REUBEN MEEKS ALL RIGHT, TITLE AND INTEREST OF THE CITY OF
<br />SAN MARCOS IN AND TO SUCH AN EXTENSION OF PEGUES STREET TO
<br />BLUEBONNET DRIVE AND DIRECTING THE MAYOR TO EXECUTE AND DELIVER
<br />TO SAID PERSONS QUITCLAIM DEEDS OF THE EXTENSIONS OF PEGUES STREET
<br />TO BLUEBONNET DRIVE.

<br />Mr. Hansen moved approval of the Ordinance on second reading. Mr. Flores
<br />seconded the motion. Mr. Breihan moved to table the ordinance and place
<br />the matter on the next workshop agenda for diacussion. Mr. Cunningham
<br />seconded the motion to table; on roll call, the following vote was recorded:

<br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES
<br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND
<br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOTS
<br />25 AND 26 AND PART OF LOT 24 OF BLOCK 14 OF THE SUNSET ACRES
<br />ADDITION NUMBER TWO, LOCATED ALONG THE NORTHEAST RIGHT-OF-W.\y.LINE
<br />OF HIGHWAY 123 AND ITS INTERSECTION WITH BROADWAY STREET, FROM
<br />"C" (COMMERCIAL) TO "C-2" (COMMERCIAL).

<br />Mayor Craddock read the attached letter from Attorney J.R. Molina representing
<br />the applicant, Ralph Gonzales, and a memorandum from the City Attorney, also
<br />attached. Mr. Dibrell moved the Ordinance not be approved. Mr. Sutton
<br />seconded the motion. Mr. Molina came before the Council to state that his
<br />client was prepared to place a restrictive covenant running with the land
<br />in perpetuity to be enforced by the a4jacent and abutting property owners
<br />to be enforced by them by court injunction. Mr. Molina stressed that this
<br />was a unilateral offer by Mr. Gonzales to the Council. Those coming before
<br />the Council to object to the zoning change were Gordon Harmon, Superintendent
<br />of Schools, George Gilbert and Carrol Burton. Mr. Hansen moved to table
<br />the third reading of the Ordinance to allow the applicant time: to negotiate
<br />with adjacent property owners. Mr. Flores seconded the mottion, and on roll
<br />call, the following vote was recorded:

<br />NAY: Breihan, Dibrell, Sutton.

<br />Mr. Flores moved the Ordinance be approved on third reading. Mr. Cunningham
<br />seconded the motion which passed unanimously. The Mayor declared the
<br />Ordinance Passed, Approved and Adopted.
