The applicant, Pedro Frank Ramirez, was not <br />present. John Morriset and Darrel Robinson came before the Council as <br />adjacent property owners to object to the granting of the permit. Mr. Sutton <br />moved the request be denied. Mr. Dibrell seconded the motion, which passed <br />unanimously. <br /> <br />II <br /> <br />Mayor Craddock introduced a request for thereplatting of Lots 535 and 536 <br />in the Westover Addition, located at the corner of Hamilton Avenue and <br />Hillyer Street. Mr. S.R. Rutledge, applicant, came before the Council to <br />explain that the replatting was necessary in order that conformance to the <br />lot size requirements of the General Zoning Ordinance for "R-2" zoning. <br />Mr. Cunningham moved the replat be approved. Mr. Flores seconded the motion, <br />which passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND <br />LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART <br />OF LOT 9 OF THE A.B. ROGERS SUBDIVISION, AND PART OF .62 ACRES OUT OF <br />THE J.M. VERAMENDI LEAGUE NUMBER TWO, LOCATED BETWEEN THE I.H. 35 <br />ACCESS ROAD AND LINDA DRIVE AND BETWEEN NORED REAL ESTATE AND THE EXXON <br />STATION, FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL). <br /> <br />Mr. Dibrell moved the Ordinance be approved on second reading. Mr. Flores <br />seconded the motion. Mr. Sutton requested written confirmation of the <br />National Building Center's concurrence with staff recommendations and estimates <br />concerning extension of utilities. On roll call, the motion to approve the <br />second reading of the ordinance passed unanimously. <br /> <br />The Mayor read the caption of an ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT CERTAIN <br />ORDINANCE DATED SEPTEMBER 11, 1972, WHICH VACATED, ABANDONED. AND <br />CLOSED CERTAIN PORTIONS OF ACADEMY, JAMES, NORTH AND ALAMO STREETS <br />IN SAN MARCOS, TEXAS, AND AUTHORIZED THE EXECUTION OF A QUITCLAIM <br />DEED FROM SAID CITY TO SAN MARCOS BAPTIST ACADEMY. BY REPEALING THE <br />LEGAL DESCRIPTION OF SAID STREETS, AND SUBSTITUTING IN ITS PLACE A <br />NEW LEGAL DESCRIPTION FOR THE CLOSING AND ABANDONING OF SAID STREETS. <br /> <br />Mr. Flores moved the Ordinance be approved on second reading. NELSON FIRST ADDITION TO SAN MARCOS, TEXAS, <br />AND RELINQUISHING TO HUGH A. NELSON, JR. AND MARIAN NELSON MEEKS ALL <br />RIGHT, TITLE AND INTEREST OF THE CITY OF SAN MARCOS, TEXAS, IN AND <br />TO EZELL STREET AND THE NORTHWEST 983.5 FEET OF PEGUES STREET AND <br />DIRECTING THE MAYOR TO EXECUTE AND DELIVER TO SAID PERSONS QUITCLAIM <br />DEEDS TO EZELL STREET AND SAID PORTION OF PEGUES STREET. <br /> <br />Mr. Flores moved approval of the Ordinance on second reading. Mr. Hansen <br />seconded the motion. Mr. Breihan stated his concern with traffic flow and <br />drainage problems which might aecomp~ny development of the property, and <br />moved the second reading of the Ordinance be tabled and placed on the next <br />workshop agenda for further discussion.
