<br />r <br /> <br />( <br /> <br />I <br /> <br />,I <br /> <br />'I <br /> <br />SECTION 5. <br />The above charges governing the pick-up of garbage at <br />commercial establishments shall not apply where the owner, <br />manager or lessee of any such commercial establishment does <br />not provide garbage cans which comply with the requirements <br />concerning such receptacles as set forth in the "Garbage <br />Ordinance" of the City of san Marcos; but, instead in such <br />cases of non-compliance, the charges for picking up such <br />garbage shall be calculated at the rate of $18.00 per hour <br />based upon the weekly average collection time. <br /> <br />SECTION 6. <br />All ordinances, resolutions, or parts of ordinances or <br />resolutions, in conflict herewith, are hereby repealed. <br /> <br />SECTION 7. <br />If any article, subdivision, paragraph, clause, section, <br />phrase, or sentence of this ordinance, or the application <br />thereof to a particular person, set of persons, or to a <br />particular set of circumstances, should, for any reaso~, be <br />held invalid, such invalidity shall in no wise affect the <br />remaining provisions hereof, and to such end the various pro- <br />visions hereof are declared to be separable. <br /> <br />SECTION 8. <br />This ordinance shall become effective on December 1, 1971, <br />after due legal passage and publication in a newspaper of general <br />circulation in the area. <br /> <br />PASSED AND APPROVED on first reading September 13, 1971 <br /> <br /> <br />PASSED AND APPROVED on second reading September 27, 1971 <br /> <br /> <br />PASSED, APPROVED AND ADOPTED October 11, 1971 <br /> <br />ATTEST: <br /> <br /> <br /> <br />.
