<br />6.1 That all electrical work under construction or formally contracted for <br />at the time of passage of this ordinance shall be exempted from the provisions <br />of this ordinance. <br /> <br />6.2 That no permit is required to replace any electrical fixtures or <br />appliances which require no change in the electric wiring for such fixture or <br />appliance. <br /> <br />I <br /> <br />SECTION 7. LIABILITY: <br /> <br />7.1 That this ordinance shall not be construed to relieve from or lessen <br />the responsibility of any corporation, co-partnership, association, individual, <br />or agent thereof, installing, operating or controlling any electric wiring or <br />electrical apparatus for damages to anyone thereby, or for full and faithful <br />performance of the contract, nor shall the City of San Marcos, Texas, be held as <br />assuming any liability by reason of the inspection authori~ed herein Or certificate, <br />or permit issued pursuant to the provisions of this ordinance; <br /> <br />SECTION 8. PENALTY: <br /> <br />8.1 That any person, firm, or corporation who violates any part of this <br />ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be <br />fined in any sum of not less than One Dollar nor more than Two Hundred Dollars. <br />Each and every day's continuance of any violation of the provisions of this <br />ordinance shall constitute and be deemed a separate offense. <br /> <br />SECTION 9. SAVINGS CLAUSE: <br /> <br />9.1 That if any section, paragraph, sentence, or phrase of this ordinance <br />be invalid, or unconstitutional, then such invalid or unconstitutional portion <br />shall not in any way affect the remainder of this ordinance, and it is hereby <br />declared as the intent of the City Council of the City of San Marcos, Texas, that <br />the remainder of this ordinance would have been passed by the City Council of the <br />City of San Marcos, Texas, notwithstanding the invalidity or unconstitutionality <br />of such section, paragraph, sentence, or phrase. <br /> <br />I <br /> <br />SECTION 10. <br /> <br />10.1 That all ordinances or parts of ordinances of the City of San Marcos, <br />Texas, in conflict with this ordinance be and the same are hereby in all respects <br />repealed. <br /> <br />SECTION 11. EMERGENCY CLAUSE: <br /> <br />11.1 The public welfare, health, and safety being presently endangered due to <br />the fact that the existing ordinances of the City of San Marcos do not afford an <br />adequate and comprehensive code governing the installation of plumbing facilities <br />within the corporate limits of the City of San Marcos, therefore, an emergency <br />exists, requiring the provisions of the Charter of the City of San Marcos that <br />ordinarily require ordinances to be read on three (3) several days and that no <br />ordinances shall become effective until the, expiration of ten (10) days following the <br />date of its final passage, be dispensed with; thus, this ordinance shall be effective <br />immediately upon its passage by this body and its publication in a newspaper of general <br />circulation within the City of San Marcos.
