Mr. Yarbroug'h as.ked if anyone would care to speak !'for~ or "against" the proposed zoning. B.R. Forester, 401 lamar Street, stated he was opposed to aDY change of zoning on Lamar Street, and wanted it all to remain "R-l" (single family residential). The matter was discussed, with Councilmen participating. I The Mayor 'closed the public hearing, and stated the Council would consider ordinances embodying the recommendations at a subsequent meeting. The Mayor introduced an ordinance with the following caption: AN ORDINANCE AMENDING CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITLED GARBAGE AND TRASH, BY DELETING SECTIONS 12-12 AND 12-16 THEREOF; SUB- STITUTING NEW SECTIONS UNDER THE SAME NUMBER; CREATING AN ENTIRELY NEW S~ION 12-17, DUMPING-SANITARY lANDFIll; AND PROVIDING AN EFFECTIVE DATE Mr: King moved a~proval of the ordinance on first reading. Or. Tauch seconded the motion. Councilmen raised questions on SECTION 12-16, "UNLAWFUL COllECTION", making the point that some City employees had after-hours garbage collection businesses, and depended on the extra income. The Mayor said this type of activity could be viewed as "conflict of interest", or being in competition with their employer, the City. The ordinance was thoroughly discussed._ The question being called for, the following vote was recorded: AYE: Emery, Yarbrough, King, Tauch NAY: Dela Rosa, Etheredge, Flores I The Mayor declared the ordinance passed on first reading, by a 4 to 3 vote. The Mayor introduced an ordinance with the following caption: AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, ENTITlED"WATER AND SEWER AND SEWAGE DISPOSAL" BY DELETING THE PRESENT SECTIONS 30-1, 30-2, AND 30-5 OF ARTICLE 1 THEREOF; SUBSTITUTING NEW SECT- IONS UNDER THE SAME NUMBERS; CREATING NEW SECTIONS 30-7, "DEPOSIT", AND 30-8, "RECONNECT FEES~; DELETING THE PRESENT SECTIONS 30-27, 30-28 AND 30-35 OF ARTICLE 11 THEREOF; SUB- STITUTING NEW SECTIONS UNDER THE SAME NUMBERS; AND PROVIDING AN EFFECTIVE DATE Mr. King moved approval of the ordinance on first reading. Mr. Etheredge seconded the motion, which passed unanimously. The Mayor declared the ordinance passed on first reading. The Mayor introduced an ordinance with the following caption: I
