<br />The Mayor declared the motion passed and the Ordinance nd approved.

<br />The M~yor introduced an Ordinance with the following captfon:

<br />AN ORDINANCE DEDICATING CERTAIN ~EAL PROPERTY, TITLE
<br />TO WHICH IS PRESENTLY VESTED IN THE CITY OF SAN MARCOS,
<br />TEXAS, FOR PARK A NO RECREAT JONAL PURPOSES; PROV,I DING
<br />CERTAIN EXCEPTIONS TO SUCH DEDICATION; AND REPEALING
<br />ALL ORDINANCES IN CONFLICT HEREWITH.

<br />The City Sec'retary read the Ord i nance in' its ent I rety. Mr. De La Rosa
<br />moved ,to table the Ordinance until the certification of a petition
<br />accompanying a similar ordinance could be further studied. Hearing
<br />no sec~nd, the Mayor declared the motion fai led. Mr. Cunningham
<br />moved the approval of the Ordinance on first reading. Mr. King
<br />seconded the mot ion. The Mayor ca 1,1 ed f,or discuss i on. Mr. Rodger
<br />Zimmerman, attorney for signers of the peti~iOri, protested that
<br />he had not been notified of ,the results of the certification. The
<br />Mayor explai'ned that the petition had been. fou~.dto'be not sufficient,
<br />and ~sked the City Attorney to further explain. Mr~ Walker stated
<br />that the Charter required the City Secretary to present the
<br />certificati'on t'o the Counci I, and then to notify the petitioner of
<br />th'e results. T~e,City Secretar'y read the ceri;,if'ication in full.
<br />After furth~r discussion, Mr. Etheredge called for question. On

<br />The Mayor declared the Ordinance approved on first reading.
<br />
<br />Councilman Etheredge cdmmented on the events which had resulted
<br />in the formal dedication of the City's park lands. He said
<br />that, in his opinion, ,the Parks and Recreation Board had "abused
<br />all rules of ethics" by hiring an attprney to prepare a petition
<br />protesting the Council's choice of a site for the proposed Police
<br />and Courts Building. "They have a legitimate cause as individuals,
<br />but not as a board created and appo i nted, by th i s ~ounc i I", he stated.
<br />Mr. Etheredge expressed his de.sire to see greater copperationbetween
<br />the Counc i I and its subord i nate boards and comm; ttees; and a g'reater
<br />~ffort to "make news as ~ community concerned enough to wor'k and
<br />, learn to grow together, to ad~pt to the times...capable and wort~
<br />of creating a future that we and our chi Idren can be proud. of".

<br />The Mayor introduced a Resolution authorizing approval of the
<br />second year of the Concentrated Code Fnforcement Program.
<br />Mr. Yarbrough moved the Reso I ut i on be, approved. Dr. Tauch seconded
<br />the mo;t i on. Mr. Yarprough requested a report 0'/1 the progress and
<br />status of,the first year of the. program., TheCit)l Manager listed
<br />the expenditures and financial status of the first ten months of
<br />the program, and explained, in answer to a question from Mr. King,
<br />that the problem in connection with qual ified contractors to I
<br />carry out the work had been alleviated. After further diacussion,
<br />the Resolution was unanimously approved.

<br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDiNANCE WHICH
<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY
<br />CHANGING THE ZONING OF 4 ACRES, TRACTS A AND,S OF THE
<br />CRESTWOOD SUBDIVISION, FROM "C" (COMMERCIAL) TO "12-2"
