<br />/53 <br /> <br />regular meeting, august 14, 1972 <br /> <br />page two <br /> <br />Mr. and Mrs. Sam Kone, owners of property across the street <br />from that in question, stated their objections to the <br />proposed use of the property. They felt it would downgrade <br />the neighborhood and create a poor impression on tourists and <br />newcomers to San Marcos since d twas" ocated on a ma in thorough- <br />fare entering the City. As there was no further discussion, <br />the public hearing was closed. <br /> <br />The Mayor introduced an Ordinance with the fol lowing caption: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH I <br />REGULATES ,AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, <br />STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY <br />CHANGING ,THE ZONING OF BLOCK 9, THE SOUTHERLY HALF OF <br />LOT 7, ORIGINAL TOWN OF SAN MARCOS, FROM "C" (COMMERCIAL) <br />TO "C-2" (COMMERCIAL) <br /> <br />Mr. Cunningham moved the ordinance be approved on first reading. <br />The motion was seconded by Dr. Tauch. Questioned by Mr. Yarbro~gh, <br />the City Manager stated that the business located on the property <br />was present I'Y in operat i onand, hav i ng the status of a rest au rant, <br />was serving alcohol ic beverages. David Calvery, a part-owner in <br />the business, stated that it was upon advice of the owner of ~he <br />prop~rty, Mr~ Wil I iam Backus, that the change in zoning was <br />requested. It was his opinion that the serving of food might not <br />be financ~ally profitable. In that case, the owners of the <br />establ ishment would be protected by the zoning change. Mr. Yarbrough <br />stated again his concern with granting "C-2" zoning changes to <br />"benefit individuals instead of benefiting the entire community". <br />Dr. Tauch said that he was more in favor of granting this classi- <br />fication in commercial business areas rather than residential <br />areas. Mr. Cunningham pointed out that most of the business at <br />the establ ishment would occur after 5:00 p.m. when other businesses I <br />in the area were closed for the day. Mr. King proposed the <br />ordinance be tabled since there se~med to be some concern over <br />the zoning amendment which created the "C-2" classification; <br />however, Mr. Cunningham was not in favor of withdrawing hi$ motion. <br />Question being called for, on roll call the following vote was <br />recorded: <br /> <br />AYE: -Cunningham, Etheredge, Tauch <br /> <br />NAY: DeLa Rosa, Flores, King, Yarbrough <br /> <br />The Mayor dec I ared the mot i on fa i I ed and the request for <br />rezoning denied. <br /> <br />, The Mayo~ opened a Publ ic Hearirig to con~ider a request for a <br />change in zoning on Lot 5 and parts of Lots 64 and 65 in the <br />Park Addition, from "R-1" to "R-2". Mr. Stephen L. Box, owner <br />of the property, stated that he w i'shed to deve I opthe property to <br />generate more income from it, but that he also understood the <br />rezoning would creat a beneficial buffer-between the residential <br />and multi-fa~i Iy properties in the area. Mr. Yarbrough noted that <br />the Planning and Zoning Commission had recommended approval of <br />the request.
