<br />(~ <br /> <br />regular meeting, september 28, 1970 <br /> <br />page two <br /> <br />call, the following vote was recorded: <br /> <br />AYE: <br /> <br />Contreras, Craddock, Flores, Ki ng, Smith, <br />Yarbrough, Zavesky <br /> <br />NAY: <br /> <br />None <br /> <br />The Mayor declared the Ordinance Passed, Approved <br />and Adopted. <br /> <br />The Mayor introduced an ordinance annexing a tract of <br />land on Uhland Road belonging to Mrs. Martha Kaiser. <br />Mr. Zavesky moved adoption of the ordinance on third <br />and final reading. Mr. Contreras seconded the motion <br />and on roll calL the following vote was recorded: <br /> <br />I <br /> <br />AYE: <br /> <br />Contreras, Craddock, Flores, King, Smith, <br />Y~ab~ough, Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared the Ordinance Passed, Approved <br />and Adopted. <br /> <br />The Mayor introduced an ordinance annexing a tract of land <br />on River Road owned by Mr. Leopoldo Garza. Mr. Zavesky <br />moved adoption of the ordinance on second reading. <br />Mr. Contreras seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced an ordinance annexing Subdivision <br />Tanglewood #4, owned by Mr. W.S. Rader. Mr. Yarbrough <br />moved adoption of the ordinance on second reading. Mr. King <br />seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />Mrs. Maggie Jones appeared before the Council to request <br />a change of zoning from "R" to "D"(multi-family) on a <br />two-acre tract on Lamar Avenue. Her request had been <br />denied by the Planning & Zoning Commissirin after a public <br />hearing. Mrs. Jones said she had a tentative sale for the <br />property if it were ~oned. for apartments. She said she <br />had owned the property for 54 years, was born and reared <br />in San Marcos, and had paid taxes all this time. She is <br />no longer able ~o live alone and wanted to realize as much <br />as possible out of the sale. <br />The Mayor stated the action of the Planning & Zoning <br />Commission was influenced by protests from more than 20% of <br />adjacent property-owners; and by concern for further congest- <br />ion of traffic on a narrow street. <br />Mr. Yarbrough expressed the concern of the Council for the <br />position Mrs. Jones finds herself in, and moved that the matter <br />be tabled until the next meeting, to afford Councilmen to give <br />it further study. My.>. King seconded the motion. The Mayor <br />asked: "What do you want to study? This lady wants an,answer". <br />Mr. Yarbrough said: "I'm not sure it shouldn't be rezoned. <br />Mrs. Jones is caught with property that is considered bene- <br />ficial as a "buffer zone" between single,.family residences <br />a nd apartments;" I t 'was suggested that the prospective buyer <br />might be willing ,to dedicat.e a strip of the two acres as a <br />buffer, in considerationrifachange of zoning.
