I

I

I

TOM G. OLIVER, JR.
ATTORNEY AT LAW

FiRST FEDERAL SAVINGS AND LOAN ASSOCIATION BUILDING

SAN MARCOS, TEXAS 78666

January 14, 1971

Mr. Richard Bean, Manager
and Honorable Mayor and
City Council of City of San Marcos
San Marcos. Texas

Gentlemen:

There has recently been filed for record the approved Plat
of Spring Lake Hills Estate, Unit Seven, and the Estate of Paul J.
Rogers, deceased, has entered into the contract with you for the
installation of sewer and water lines under and in accordance with
the present existing ordinance on said dubject.

The entire subdivision is yet intact and no conveyance of
any of said lots has as yet been executed.

This letter is written to you with respect to the ten foot (10')
utility easement shown on said plat which is between Lots Nos. Two
(2) and Three (3) in Block "c" of said subdivision.

The said ten foot (10') easement for public utilities was created
for the purpose of carrying water lines from Laurel Lane to Lot No.
Seven (7) but we now find that it would be better for the said Lot No.
Seven (7), in our opinion, to be served by,. the water line which is now
in Alta Vista Drive, upon which the said Lot No. Seven (7) abuts.

Under these circumstances we desire to request that the $-ai~
easement be abandoned and vacated as soon as possible by.,OfftC;:;l
action of the City of San Marcos.
