EXECUTIVE SESSION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, JANUARY 25, 1971 Present: Mayor Hollis W. Smith Councilmen: Luciano H. Flores Ross King Herbert A. Yarbrough, jr. Jerry Zavesky I City Manager City Secretary City Attorney Richard G. Bean Dorothy O. Worrell Albert M. Walker Also present: Rodger M. Zimmerman, William M. Rugeley, Kenneth Vaughn, J.W. Rinn The Mayor called the meeting to order at 5:30 p.m. and read aloud a letter from Rodger M. Zimmerman, see attached. Mr. Zimmerman, speaking on behalf of his client, Kenneth Vaughn, requested the Council to make an investigation of alleged police misconduct on December 27, 1970, in which Patrolman Clifton H. Grumbles is purported to have struck Kenneth Vaughn on the back of the head while subject was handcuffed, seated in the front of a patrol car. I Mr. Zimmerman recounted in full what his client had told him of~he,events taking ,place on December 27, 1970. He isked for an answer within a week to his request for a Council in- vestigation, stating that if the decision were negative to his client's interests, he would file suit against the City. City Attorney Walker asked Mr. Zi'mmerman to send the Council a letter stating his accusations against the three patrolmen. Mr. Zimmerman agreed. The Council agreed to give Mr. Zimmerman an answer to his request by February 1. Following the departure of the visitors, the Council consider- ed Mr. Zimmerman's request. The Council agreed by common consent to meet at 5:30 p.m., January 28, to hear reports from the three police officers involved in the Vaughn case. The Council January 28. I l ATTES.
