<br />I <br /> <br />I <br /> <br />I <br /> <br />regular meeting, may 10, 1971 <br /> <br />Dage three <br /> <br />The Mayor read a letter from Ralph Gonzales, submitting <br />his resignation as Commissioner of the Urban Renewal. Agency. <br />Mr. Flores moved that the resignation be accepted. Mr. Smith <br />seconded the motion, with a request that al.etter of apprec- <br />iation for hisservi~es on the Urban Renewal Board be sent <br />Mr. Gonzales. 'The motion passed unanimously. <br /> <br />The Mayor introduced some recommendations forwarded from <br />the Plannin8 & Zoning Commission, see atta,ched letter. <br />First item considered was a request that all the areas in the <br />Fo~est Hills and Bluebonnet Hills outside the City Limits be <br />annexed arbitrarily by the Council. David Pool, Chairman of <br />the Planning & Zoning Commission, spoke to the' question. A <br />number of citizens whose property would be affcted by the <br />annexation were present to ask'questioh~ .b66t utility service. <br />All aspects of the annexation were discussed,. Mr . Kin!:)" moved <br />that proceedings be started on publication of notice of a <br />public hearing on the proposed annexation. Mr. Flores seconded <br />the motion which passed unanimously. <br /> <br />The Mayor announced that protests regarding two rezoning <br />recommendations from the Planning & Zoning Commission had been <br />received from Mr. J. N. Holmes, and ;3" group of "property-owners <br />in Hughson Heights. Mr. Yarbrough said the City Attorney had <br />been consulted about the proper procedure in such situations, <br />and asked Jack Major to relay Mr. Walker's legal opinion. <br />Citing Arts. 1011d & tOlle, Vernon's Annotated Civil Statutes <br />of Texas, ,the City Attorney ruled that the Council is required <br />to hold a public hearing when protests ;3re presented 'in writing <br />to the City Secretary, The matter was discussed at length with <br />concerned citizens at the meeting. <br />Mr. King moved thci,t a public hearing be called at the Public <br />Library as SOOl) as legally possible, preferably on Wednesday, <br />June 2, 1971, at 7:10 p.m., to consider the protests of <br />Mr. Holmes, and the grOup from Hughson Heights, represented by <br />Mr. Marcus Jackson. Mr. Etheredge seconded the motion, which <br />passed unanimously. <br /> <br />The Council considered a recommendation fromthe Planning & <br />Zoning Commission that a request from Mrs. Laura L. Ramsay and <br />Mr. Charles R. Ramsay for change of zoning from R-l to "M" be <br />gcanted on the following property: <br />Lts. 45,58,72,73,74,75-57,71,70,61-69,62,55,49,54,63, <br />46-53,64-81,82,83,84 and 85 out of the A.M. Ramsay <br />Subdivision. <br />Mr. Smith moved approval of the request for rezoning. Mr. Flores <br />seconded the motion, which passed unanimously. <br /> <br />Final item on Planning & Zoning matters was a recommendation <br />from the Commission that properties owned by Mrs. Katherine <br />S. Hardeman and Mrs. Sophie S. Smith, located on Old Wimberley <br />Road (now Lyndon B. Johnson Drive) be arbitrarily annexed by <br />the City. Mr. Flores moved that proceedings be started on <br />publication of notice of a public hearing on the proposed <br />annexation. Mr. Etheredge seconded the motion, which passed <br />unanimously. <br /> <br />The Mayor introduced a Code Enforcement Grant Application <br />Resolution. Harry Jewett of Clifford Cason Associates explained <br />the program. A map of the area to be affected by the Code Enforce- <br />ment Program was studied. A number of minor errors on the map <br />were pointed out. Mr. Jewett said the Council could extend or <br />extract any properties in the 172-acre area before the program <br />begins. Mr. Smith moved approval of the Resolution. Mr. Flores <br />
