The motion was <br />seconded by Mr. King, and unanimously approved. <br /> <br />Warren Leddick, Parks & Recreation Oi~ector; gave a report to <br />the'Council on theSuminer Recreation Program at the park and <br />schools. The Mayor commended Mr. Leddick for initiation of a <br />good program. <br /> <br />Mr. Leddick presented for Council approval a sched~le of ,fees <br />and rules for the park and ball 'fields. Several questi(;ns were <br />raised. Mr. DeLa Rosa moved that the schedule be tabled for <br />further study. Mr. Flores jeconded th~ motion and on roll call, <br />the following vote was recorded: <br /> <br />AYE: DeLa Rosa, Etheredge, Flores, King, Yarbrough <br />NAY: Emery <br /> <br />The Mayor declared the'motioh carried. <br /> <br />Marcus Jackson was recognized by the Mayor. He said he'd had <br />time to read the City Attorney's ruling since he had first spoken <br />to the rezoning of certain lots in Hughson Heights, Addition No.1. <br />He "respe<::tfuUy requested 'the Count1l to h~e'dthe 'City Attorney" <br />and get a ruling from Texas Municipal League prior to the third and <br />final reading of the ordinance amending the zoning ordinance. <br /> <br />Mr. Etheredge moved that the City Attorney be asked to consult the <br />legal counsel for Texas Municipal League, prior to the third reading <br />of the ordinance amending the zoning map to show a change in <br />Sectioh "D", Hughson Heights Subdi.Jision, Addi tion N".1. <br />Mrs. Emery seconded the motion. Mr. DeLa Rosa commented that if <br />the City Attorney h~d wanted to contact Texas Municipal League, he <br />would have done s6~efore giving his opinion. On roll call, the <br />following vote was re<::orded: <br /> <br />AYE: Emery, Etheredge, Flores, King <br />NAY: DeLa Rosa <br />ABSTAIN: Yarbrough <br /> <br />The Mayor declared the motion carried. <br /> <br />Mr. King moved that the Council recess to executive session, to <br />discuss purchase of right-of-way. Mrs. Eme~ys~conded the <br />motion, which passed unanimously. <br /> <br />EXECUTIVE SESSION <br /> <br />The Council reconvened in executive session at 9:10 p.m., with <br />all members present. <br /> <br />Mr. King, speaking for the Land Committee, disclosed that <br />Mrs. Luciano Flores owned a lot needed for widening of Sessom Drive. <br />He explained that the City had already taken a portion of the lot, <br />and that Mr. and Mrs. Flores accepted the assessed value, rather <br />than cause an embarassing situation on the Council. Now, the <br />engineers require additional footage for drainage, which will, in <br />effect, make the lot unsuitable for a residence. Glenn Gray, <br />appraiser for the City, had offered a price which seemed unreason- <br />ably low: $545.00. Mrs. Fkores refused to sell at that price, and <br />made a counter proposal of $750.00 for the lot. Mr. King said he <br />had asked for an executive session so Councilmen would feel free to <br />make any comments they wished to about the price. <br />It was agreed by common consent that $750.00 was a fair price <br />for the lot. <br />
