On", item, a petition tior <br />annexation of 15.1 .creson Uhland Road owned by <br />J.C. Varner, required action. Mr. Dannelley moved <br />acceptance of the petition for annexation. Mr. Con- <br />treras seconded the motion, which passed unanimously. <br /> <br />The second item referred to a request for rezoning of <br />property, owned by Richard Del Cueto which had been <br />~tileUedt the November 17 meeting, until a full Council I <br />could be present. Mr. Del Cueto had requested a change <br />of zoning from "R-l" to "R-2", to permit construction of <br />a duplex. Mr. Flores deplored the fact that the Council <br />had delayed action on the matter fon almost a month. <br />Mr. Dannelley expresse~ opposition to the change of <br />zoning for .several reasons. He said that more than 20% <br />of the property-owners within 200 feet of the property <br />had objected to the change of zoning at the public hearing. <br />Mr. Darinelley said he understood a four-lane street was <br />planned'whenthe new Cheatham Street bridge is built, and <br />if a duplex we.re built on the lot, there would not be <br />sufficient property available for the required right-of-way. <br />H~ said members of the Planning & Zoning Commission should <br />check the City's Comprehensive Plan. and Urban Renewal plans <br />before recomm~ndinga change ~fzoning in areas under de- <br />velopment or improvement. In answer to a question from <br />Dr . Craddock, Mr. Bean st,ated that in the past the Planning <br />and Zoning Commission had followed a policy of automatically <br />denying a request for. change of zoning when 20% or more of <br />the property-owners within 200 feet objected at the public <br />hearing. It had been determined, however, the City Manager <br />said, that the Commission was not required legally t,o deny I <br />the request, but could ~akerecommendations to the Council <br />on their own judgement. A plat of the area in question was <br />examined. and the ~equ.st discussed. Mr. Dannelley moved <br />that the req.est for' rez~ning of the Del Cueto property be <br />denied. Mr. Smith seconded the motion. On roll call, the <br />following vote was recorded: <br /> <br />AYE: Craddock, Da'nnelley, Serur, Smith, Zavesky <br />NAY: Contreras, Flores <br /> <br />Th~ Mayor declared the motion to deny the requ~itf~r <br />rezoning had passed by a vote of 5 to 2. <br /> <br />The Mayor read aloud a report from the committee appointed <br />to study United Gas Corporation's request for ~ rate increase. <br />The report, signed by Dr. Emmie Craddock, Ronald J. Dannelley <br />and Jerry Zavesky, is attached and made a part of the Minutes. <br />The Mayor recommended that the 'report be discussed item by <br />item. Dr. Craddock said she would like to go on record as <br />being opposed ,to "the escalatIon clause" in United Gas Corp.' s <br />proposaL stating that any time a change of rate is cilntem- <br />plated, the Co~ncil should appr~ve it. Mr. Smith agreed. <br /> <br />I <br /> <br />Mr. J.R. Uhr, District Manager for United Gas, came before <br />the Council and urged that the ordinance authorizing the <br />rate increase, cis originally proposed at the Jan. 2.7, 1969 <br />meeting, be adopted.
