Mr. Pool <br />suggested that the City call the Texas Water Quality Board <br />about a possible violation of the Anti-Pollution Act, and that <br />the Council direct the City Attorney to file an injunction <br />against the development firm in order to stop the project until <br />more informat;ion,could, l;>e obt,i'lined, ,and proper judgements made. <br /> <br />The Mayor saidt the only recourse the City had was to call a <br />public hearing on the annexation proposed by the Planning & Zoning <br />Commission, so that all sides of the matter might be heard, before <br />the City took action. <br /> <br />Dr. T.R. Buie said he was not authorized to speak for the develop- <br />ers, but he had sold them the property, and still had interests in <br />the area. He said some of the facts had been misrepresented. He <br />said hetJndersto,Qd~ the developers planned to spend $2,000,000, <br />with facilities that would meet State standards, and a sewage dis- <br />posal plant comparable to the City's new waste water treatment plant. <br />Dr. B,uies,aid the, plans for the mobile home park would exceed al1Y- <br />thing the City requires, and be an asset to the Ci1ty of San Ma'rcos. <br />He stated he felt those protesting were unduly alarmed. <br /> <br />Councilman Yarbrough moved that the City call a public hearing oil <br />the earliest possible date, to consider arbitrary annexation of <br />the tract as recommended by the Planning & Zoning Commission. <br />Mr. Zavesky seco~ded the motion and on roll call, the following <br />vote was recorded: <br /> <br />AYE: Craddock, Contreras, Flores, King, Smith, Yarbrough, <br />Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared the motion carried. <br /> <br />Among those who spoke in favor of the City's taking action to <br />stop development of the mobile home pa~k were Donald Tuff, Stanley <br />Sissom, William Castleberry, Mrs. David R. Stevens and J.E. Younger, <br />Y~~b~O~1~ ' <br />Mr. /!( SIHI!jsr asked if the property-owners were planning to take <br />action on their own. Mr. Sissom replied that a group of interested <br />persons had employed Mr. Ernest Morgan to advise them on proper <br />legal steps necessary to protect their property. <br /> <br />jr. <br /> <br />Dr. Craddock suggested that the Council ask the Commissioners Court <br />to cooperate in extending planning outside the City Limits. In <br />answer to the Mayor's query, Dr. Craddock said she would like to <br />see a meeting arranged between the Commissioners Court, the Council <br />and the Planning & Zoning Commission, to discuss developments outside <br />the municipal boundaries which directly affect the City. <br /> <br />Dr. Craddock moved that the City Attorney be asked to give the <br />Council an opinion on the legal steps the City might take to stop <br />development of the mobile home park until a full study could be made <br />of its adverse effects on the community. Mr. Flores seconded the <br />motion and on roll call, the following vote was recorded: <br /> <br />AYE: Craddock, Contreras, Flores, King, Smith, Yarbrough <br />Zavesky <br /> <br />iNAY: None <br /> <br />The Mayor declared the motion carried. <br />
