<br />,(Ii <br /> <br />regular meeting, may 25, 1970 <br /> <br />page two <br /> <br />should be called within 45 days. <br />The Mayor c.oinmended Mr. Brown for the excellent work lie had <br />done, resulting in the project being 30d,ays ahead of schedule. <br /> <br />The Mayor introduced discussion on a request for rezoning of <br />property located in the 400 block of North Guadalupe Street. <br />Councilman King moved that the property in the 400 block of <br />North Guadalupe Street presently zoned PO" (multi-family) and <br />"P-2" (public use) be rezoned "C" (commercial). Mr. Flores I <br />seconded the mo.ti on andu on roll call, the f ollowi ng vo'te was <br />recorded :. <br /> <br />.AYE: Contreras, Craddock, Flores, King, Smith, <br />Yarbrough, Zavesky <br /> <br />NAY: None <br /> <br />The Mayor" declared the motion carried. <br /> <br />W.C. Carson, agent; Moffett Adams, architect; and Matt Ottea, <br />attorney, came before the Council on behalf of their client, <br />John Niglizzo. A plat of proposed development of a 326-acre <br />tract near Sunset Acres owned by Mr. Niglizzo had been rejected <br />by the Planning & Zoning Commission, and this was an appeal <br />tp .the Council. for further' review of the plans. David Pool, <br />Chairman of the Planning & Zoning Commission, explained to the <br />Council the '.reasons the plat was not approved. He suggested <br />a "compromiseP plan, which would take out multi-family units. <br />Moffett Adams explained the subdivision plan to the Council. <br />He pointed out the benefit .to the City through increased taxes. <br />It was brought out during the discussion that residents of <br />Sunset Acres, and others, Nho had protested against ~he devel- <br />opment at the May 19publi".hearing did not live within 200 feet <br />of the tract, but several blocks away. <br />Councilman Contreras' emphasized that the Comprehensive Plan <br />of the City must be followed. <br />Matt Ottea, attorney .for .the property-owner, sai'd it. was obvious <br />~hat ~he plan was Pcompletely unacceptable" to the Planning and <br />Zoning Commission and the Council. He said Mr. Niglizzo had <br />own.ed the land since 1963,. and expected to g,et some return on <br />h.is investment through development of. the propel"ty, but they <br />would try to dev,elop .a plan that would he approved; He stated <br />his. client was.. willing to donate 12 acr.es of his land to the <br />school system. <br />Councilman King moved that the property-owner go back to the <br />Planning & Zoning Commission Bndnegotiate a wo~kable plan, <br />abiding by the Comprehensive Plan as nearly as possible. <br />Dr. Craddock seconded the motion and on roll c.all the following <br />vote was recorded: <br /> <br />I <br /> <br />AYE: Contreras, Craddock, Flores, King, Smith, <br />Yarbrough, ,Zavesky <br /> <br />NAY: None <br /> <br />The Mayor declared the motion carried. <br /> <br />Mr. Augustin Lucio and Mr. Joe Nicola expressed dissatisfaction <br />with the subdivision plan, even in a revised concept. <br /> <br />I <br /> <br />Mr. A.H.
