<br /> <br />San Marcos, Texas <br />June 19, 1970 <br /> <br />/1& <br /> <br />, <br /> <br />City Council <br />City of San Marcos <br />San Marcos, Texas <br /> <br />Gentlemen: <br /> <br />The undersigned do hereby respectfully submit the follow- <br />ing petition: <br /> <br />I <br /> <br />THAT WHEREAS, a map or plat of the First and Second <br />Divisions of the Park Addition to the City of San Marcos is of <br />record in Volume 54, Page 420, Hays County Deed Records, which <br />map or plat, and its record, is hereby referred to and made a <br />part hereof for all pertinent, legal and descriptive purposes; and, <br /> <br />WHEREAS, the said map or plat has delineated thereon various <br />lots, blocks, streets and alleys, and one of said alleys is shown to <br />be 16.08 to 16.61 feet in width and 349.44 to 364.46 feet in length, <br />and containing 0.14 of an acre of land, according to survey made from <br />the public records by James R. Hall, Hays County Surveyor, during <br />June of 1970, said alley extending along the Southwest lines of Lots <br />Nos. 35 and 16 on the one hand and along the Northeast line of Lot <br />No. 15 and acreage designated "A. S. Burleson" on said map or plat; <br />and <br /> <br />I <br /> <br />WHEREAS, the said map or plat is accompanied by deed of <br />dedication of the streets and alleys shown on said plat to the use <br />of the public, but there is not indicated on said plat or elsewhere <br />any acceptance by the County of Hays or the City of San Marcos, nor <br />have the County of Hays and City of San Marcos ever exercised ,:nOr <br />is either of them now exercising any jurisdiction over any part of <br />said alley, and no part of said alley has ever been graded, gravelled, <br />paved nor in anywise used by the public as a passageway, nor has the <br />said alley ever been used by the County of Hays or City of San Marcos <br />or the public for any purpose; and <br /> <br />WHEREAS, the undersigned are the owners of all of the land <br />adjoining said alley on the Northeast and Southwest lines thereof, <br />said alley otherwise bordering on Walnut and Live Oak Streets as <br />shown on said map or plat, and the undersigned being desirous of <br />having said alley officially closed and abandoned by the City of San <br />Marcos, said Park Addition now being within the boundaries of said <br />City of San Marcos; and <br /> <br />WHEREAS, such closing and abandonment of said alley will be <br />to the mutual advantage of the City of San Marcos and the undersigned: <br /> <br />I <br /> <br />NOW, THEREFORE, the undersigned do hereby petition and re- <br />quest of the City of San Marcos that it enact an ordinance closing <br />and abandoning said alley; that the City of San Marcos relinquish <br />and quit-claim all right, title and interest of said city in and to <br />said alley to the undersigned; further, that the Mayor of said city <br />be empowered and directed to execute and deliver for and on behalf <br />of said city quitclaims to the undersigned, such quitclaims covering <br />and describing said entire alley, that such quitclaims be duly attest- <br />ed by the City Secretary, that such quitclaims be acknowledged in the <br />usual form by the Mayor and City Secretary, and that said quitclaims <br />have affixed thereto the seal of the City of San Marcos, Texas. <br /> <br />/~~ ;?M--...~ <br />~/~-~~F <br />~~~ a6-1~j,-Q <br /> <br /> <br />'j :;t/7o <br />
