<br />,V', <br /> <br />I <br /> <br />AN ORDINANCE ESTABLISHING STANDARDS FOR <br />DECLARING CERTAIN PERSONAL PROPERTY TO <br />BE ABANDONED AND A PUBLIC NUISANCE; PRO- <br />HIBITING THE ABANDONMENT OF SUCH PROPERTY; <br />PROVIDING A COMPREHENSIVE PROCEDURE FOR <br />THE IMPOUNDING, STORAGE AND SALE OF SUCH <br />PROPERTY; AND DECLARING AN EMERGENCY. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br /> <br />1. <br />ABANDONED PROPERTY DECLARED A NUISANCE; DUTY OF POLICE <br />TO IMPOUND: <br /> <br />I <br /> <br />(A) No person shall place, park or leave standing a motor <br />vehicle unattended for more than forty-eight (48) continuous <br />hours in or on any public street, alley, sidewalk, park or <br />other public place within the City of San Marcos, Texas. <br />(B) Any vehicle or other personal property or obstruction <br />placed, left standing, parked, erected or lying in violation <br />of any ordinance or the Charter of the City of San Marcos, <br />or left unattended for more than forty-eight (48) continuous <br />hours in or on any public street, alley, sidewalk, park or other <br />public place of the City of San Marcos (hereinafter known simply <br /> <br />as "City"), is declared to be a nuisance, and any such property <br /> <br />when so found by the police officers of the City shall be removed <br />or caused to be removed summarily to the police pound or any other <br />place of impoundment designated by the City Manager of the City. <br />(C) For purposes of enforcement of this Section I., proof <br />that a:cmotor vehicle found parked in violation of this Section <br /> <br />I. <br /> <br />I. was registered in the name of a particular person, firm or <br />corporation, shall constitute prima facie evidence that such person, <br /> <br />firm or corporation caused, allowed, suffered or permitted the <br />motor vehicle to be parked at the place where such violation <br /> <br />occurred. <br /> <br />II. <br />CERTIFICATION OF ABANDONMENT: The police officers of the <br /> <br />City may certify to the abandonment of any property described <br />in Section I. (B) hereof when they so find such property to be <br />-1- <br />
