<br />; I <br />I <br /> <br />left unattended for more than forty-eight (48) continuous hours <br />in or on any public street, alley, sidewalk, park or other public <br />place of the City. A record of such certification shall be main- <br />tained by the Chief of Police, with one copy thereof securely at- <br />tached to the abandoned property. The record of such certification <br />shall be prima facie evidence in any court that the property is <br />abandoned and a public nuisance. <br /> <br />III. <br />IMPOUNDMENl'--CITY MANAGER'S AUTHORITY: The City Manager <br /> <br />is authorized to cause any personal property described in Section <br /> <br /> <br />I. (B) and certified in accordance with Section II. to be seized <br /> <br />and reduced to possession. He is further authorized to provide, <br />by contract or otherwise, for the impoundment, storage and sale <br />of such property in any manner consistent with this ordinance that <br />he may deem appropriate to enforce the provisions hereof. <br /> <br />I <br /> <br />IV. <br /> <br />LIEN ON IMPOUNDED PROPERTY: A lien for all costs incurred <br /> <br />in the impounding, storing and advertisingfur sale of personal <br />property pursuant to this ordinance shall exist and inure to the <br />benefit of the person, firm or corporation actually impounding <br />such property. Such lien shall be prior and superior to all other <br />liens of every kind, save and except liens for ad valorem taxes, <br />and the impounder may retain possession of such property until ail <br />costs are paid and sell the same as provided in this ordinance. <br /> <br />V. <br /> <br />I <br /> <br />REDEMPTION OF IMPOUNDED PROPERTY: The owner or any person, <br />firm or corporation legally entitled to possession of any impound- <br />ed personal propertYal ptovided fot in this article may redeem <br />the same as follows: <br /> <br />(A) BEFORE SALE. By paying to the impounder, befote sale, <br />the impounding fee and any other actual expenses incurred by the <br />impounder in impounding and keeping the impounded property, as <br />detetmined by the fees set forth in Section XIII. hereof. <br />(B) AFTER SALE. By paying to the buyer at the sale double <br />the amount paid by him for such petsonal property, and any <br /> <br />-2- <br /> <br />L- <br />
