13 regular meeting, july 22, 1974 page three on second reading: I AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF ABSTRACT TWO, TRACT 37, LOT SIZE 85 FEET X 114 FEET IN THE T.J. CHAMBERS ADDITION, LOCATED AT 116 LAMAR STREET, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "M" (MIXED). Mrs. Shirley Wickersham was present to speak for the zoning change. Rev. C.T. Wharton spoke in opposition to the of zoning. Mr. Dibrell moved approval of the motion. Cunningham seconded the motion. On a roll call vote, following was recorded: change Mr the AYE: NAY: ABSTENTION: Breihan, Cunningham, Dibrell, Flores Craddock, Sutton Hansen In the presence of a petition signed by 20% of the property owners within 200 feet of the property in question who objected to the change, the ordinance was not approved on second reading since,a two-thirds majority vote is required by State Law to approve such an ordinance, and the request for a change in zoning was denied. Mayor Craddock read the caption of the following ordinance on third and final reading: I II AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS AMENDING THAT CERTAIN ORDINANCE DATED MARCH 8, 1971, ESTABLISHING A__ BOARD TO ADVISE THE CITY COUNCIL AND THE CITY ADMINISTRATIVE STAFF IN MATTERS CONCERNING THE ENVIRONMENT BY DELETING SECTION 2 OF SUCH ORDINANCE AND ENACTING A NEW SECTION NUMBERED 2 BY ALLOWING MEMBERSHIP TO SUCH BOARD BY CITIZENS LIVING WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY. Mr. Sutton The Qr_dinance Mayor Craddock read the caption of the following ordinance on third and final reading; AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS CHANGING THE NAME OF BOYNTON STREET TO FRANKLIN DRIVE. Mr. Flores moved approval of the ordinance. Mr. Hansen seconded the motion. The ordinance was passed approved and adopted unanimously. I Mayor Craddock introduced an award of bid for a front end loader for the cemetery. Mr. Truman Fenley, the only bidder, submitted a bid of $3,050.00. Mr. Dibrell moved to award the bid to Mr. Fenley. Mr. Hansen seconded the motion, which passed unanimously. Mayor Craddock asked the Council to receive a report from the Room Tax Committee and also consider approval of the contract between the Chamber of Commerce and the City regarding the Hotel/Motel Room Tax. Mr. Jim Hearn and Mr. Leo Poore were present to review the report and contract with the Council. (Contract is attached) Mr. Cunningham moved to accept the contract.
