82 REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOVEMBER 11, 1974 Present: Mayor Emmie Craddock Councilmen Ted Breihan William L. Cunningham Luciano H. Klossner; Ruben Ruiz; Charles Suckle; Shirley Wickersham; Patrick Nugent; Jay O'Neal; Chuck Swehla; Howard Yeargan; Allen Gill The Mayor called the meeting to order at 7:30 p.m. The Minutes of the Regular Meeting held October 30, 1974, were approved as presented on motion of Mr. Sutton and second of Mr. Hansen. I The Mayor opened a Public Hearing to consider a request for a change in zoning of part of Lot 24 and all of Lots 25 and 26 in Sunset Acres Addition Number Two from "c" to "C-2". Mr. Ruben Ruiz was present to represent the applicant, Ralph Gonzales. No objections were presented. The Mayor closed the hearing and read the caption of an Ordinance as follows: AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART OF LOT 24 AND ALL OF LOTS 25 AND 26 IN BLOCK 14 OF THE SUNSET ACRES ADDITION NUMBER TWO, LOCATED ALONG THE NORTHWEST RIGHT-OF-WAY LINE OF HIGHWAY 123 AT ITS INTERSECTION WITH BROADWAY STREET, FROM "c" (COMMERCIAL) TO "C-2" (COMMERCIAL). Mr. Sutton moved approval of the Ordinance on first reading. Mr. Flores seconded the motion. On roll call, the following vote was recorded: AYE: NAY: Cunningham, Craddock, Flores, Hansen, Sutton Breihan. I The Mayor opened a fublic Hearing to consider an Ordinance establishing a waiting period of twelve months for the filing of reapplication for change of zoning. Charles Suckle was present to represent the Planning and Zoning Commission, and stated the Commission's concurrence in the ordinance. Councilman Sutton stated his concern~with giving the Planning and Zoning Administrator the power to determine whether or not substantial changes had taken place in areas surrounding subject property of reapplications. The City Attorney informed the Council that the Zoning Board of Adjustment and Appeals was set up to hear appeals of that nature and to act as a check on the P & Z Administrator. Shirley Wickersham stated the objection that the Ordinance would discourage building and development. The Mayor closed the hearing and read the caption of an Ordinance as follows:
