83 regular meeting, november 11, 1974 page two AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT CERTAIN ORDINANCE NUMBERED 1966-19 AND CODIFIED AS APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, AND KNOWN AS THE GENERAL ZONING ORDINANCE BY ADDING TO SECTION 2 OF SAID ORDINANCE A PARAGRAPH LETTERED "D" ESTABLISHING A WAITING PERIOD OF 12 MONTHS FOR THE FILING OF REAPPLICATION FOR CHANGE OF ZONING. Mr. Breihan moved approval of the Ordinance on first reading. Mr. Cunningham seconded the motion, which passed unanimously. I Mayor Craddock introduced an Ordinance authorizing the issuance and delivery of Certificates of Obligation and cash for payment of construction Estimate #3 for the City Hall project in the amount of $12,600.00. Mr. Sutton moved approval of the Ordinance as an emergency. Mr. Hansen seconded the motion, which passed unanimously. The Mayor read the caption of an Ordinance as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THAT CERTAIN ORDINANCE WHICH ESTABLISHES THE CLASSIFICATION OF ALL POLICEMEN AND FIREMEN, THE NUMBER OF POSITIONS OF EACH CLASSIFICATION, AND THE SALARY IN STEPS FOR EACH CLASSIFICATION, BY AMENDING THAT SECTION NUMBERED 2-31 ENTITLED "JOB CLASSIFICATION AND SALARY" SO AS TO CHANGE THE NUMBER OF AUTHORIZED POSITIONS FOR FIRE TRAINEE AND FIREFIGHTER FROM 24 IN NUMBER TO 23 IN NUMBER. Mr. Hansen moved approval of the Ordinance on first reading. Mr. Sutton seconded the motion, which passed unanimously. The Mayor read the caption of an Ordinance as follows: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING ARTICLE I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, BY ADDING TO SECTION 23-1 A~REQUIREMENT THAT EACH CANDIDATE FOR PUBLIC OFFICE POST THE REQUIRED DEPOSIT AND ADDING TO SECTION 23-2 A NINETY DAY LIMITATION FOR THE POSTING OF PRINTED MATERIAL. I Mr. Cunningham requested revision of the Ordinance to allow two candidates to share a poster and pay only one deposit, as well as allowing a candidate's representative or agent to pay the deposit. Mr. Breihan said that he was mainly concerned that posters should be limited to a maximum size. By common consent of the Council, the Ordinance was returned to the City Attorney for revision and presentation at a later date. The Mayor read the caption of an Ordinance on first reading: AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TRANSFER OF FRANCHISE FOR CABLE TELEVISION WITHIN THE CITY OF SAN MARCOS PREVIOUSLY GRANTED TO COMMCO OF SAN MARCOS, INC., TO KARNACK CORPORATION OF AUSTIN, TEXAS. Mr. Hansen moved to bring the Ordinance from the table for first reading. Mr. Flores seconded the motion, which passed unanimously. Mr. Hansen moved to amend the Ordinance by extending the franchise for two years, thus giving Karnack a full fifteen years on the I franchise. Mr. Flores seconded the motion. On roll call, the following vote was recorded: AYE: NAY: Breihan, Flores, Hansen, Sutton Cunningham, Craddock. Mr. Hansen moved to amend the Ordinance further by providing that in the event the City Council either initiates a rate change or is asked by Karnack to consider a rate change, the moving party shall pay all reasonable expenses incurred by the other for outside services necessary for consideration of the proposed rate change, and
