<br />83 <br /> <br />regular meeting, november 11, 1974 <br /> <br />page two <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />THAT CERTAIN ORDINANCE NUMBERED 1966-19 AND CODIFIED AS <br />APPENDIX A OF THE CODE OF ORDINANCES OF THE CITY OF SAN <br />MARCOS, TEXAS, AND KNOWN AS THE GENERAL ZONING ORDINANCE <br />BY ADDING TO SECTION 2 OF SAID ORDINANCE A PARAGRAPH <br />LETTERED "D" ESTABLISHING A WAITING PERIOD OF 12 MONTHS <br />FOR THE FILING OF REAPPLICATION FOR CHANGE OF ZONING. <br /> <br />Mr. Breihan moved approval of the Ordinance on first reading. <br />Mr. Cunningham seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />Mayor Craddock introduced an Ordinance authorizing the issuance <br />and delivery of Certificates of Obligation and cash for payment <br />of construction Estimate #3 for the City Hall project in the <br />amount of $12,600.00. Mr. Sutton moved approval of the Ordinance <br />as an emergency. Mr. Hansen seconded the motion, which passed <br />unanimously. <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />THAT CERTAIN ORDINANCE WHICH ESTABLISHES THE CLASSIFICATION <br />OF ALL POLICEMEN AND FIREMEN, THE NUMBER OF POSITIONS OF <br />EACH CLASSIFICATION, AND THE SALARY IN STEPS FOR EACH <br />CLASSIFICATION, BY AMENDING THAT SECTION NUMBERED 2-31 <br />ENTITLED "JOB CLASSIFICATION AND SALARY" SO AS TO CHANGE <br />THE NUMBER OF AUTHORIZED POSITIONS FOR FIRE TRAINEE AND <br />FIREFIGHTER FROM 24 IN NUMBER TO 23 IN NUMBER. <br /> <br />Mr. Hansen moved approval of the Ordinance on first reading. <br />Mr. Sutton seconded the motion, which passed unanimously. <br /> <br />The Mayor read the caption of an Ordinance as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, AMENDING <br />ARTICLE I OF CHAPTER 23 OF THE CODE OF ORDINANCES OF THE <br />CITY OF SAN MARCOS, TEXAS, BY ADDING TO SECTION 23-1 <br />A~REQUIREMENT THAT EACH CANDIDATE FOR PUBLIC OFFICE POST <br />THE REQUIRED DEPOSIT AND ADDING TO SECTION 23-2 A NINETY <br />DAY LIMITATION FOR THE POSTING OF PRINTED MATERIAL. <br /> <br />I <br /> <br />Mr. Cunningham requested revision of the Ordinance to allow two <br />candidates to share a poster and pay only one deposit, as well as <br />allowing a candidate's representative or agent to pay the deposit. <br />Mr. Breihan said that he was mainly concerned that posters should <br />be limited to a maximum size. By common consent of the Council, <br />the Ordinance was returned to the City Attorney for revision and <br />presentation at a later date. <br /> <br />The Mayor read the caption of an Ordinance on first reading: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, APPROVING <br />THE TRANSFER OF FRANCHISE FOR CABLE TELEVISION WITHIN THE <br />CITY OF SAN MARCOS PREVIOUSLY GRANTED TO COMMCO OF SAN <br />MARCOS, INC., TO KARNACK CORPORATION OF AUSTIN, TEXAS. <br /> <br />Mr. Hansen moved to bring the Ordinance from the table for first <br />reading. Mr. Flores seconded the motion, which passed unanimously. <br />Mr. Hansen moved to amend the Ordinance by extending the franchise <br />for two years, thus giving Karnack a full fifteen years on the I <br />franchise. Mr. Flores seconded the motion. On roll call, the <br />following vote was recorded: <br /> <br />AYE: <br />NAY: <br /> <br />Breihan, Flores, Hansen, Sutton <br />Cunningham, Craddock. <br /> <br />Mr. Hansen moved to amend the Ordinance further by providing that <br />in the event the City Council either initiates a rate change or <br />is asked by Karnack to consider a rate change, the moving party <br />shall pay all reasonable expenses incurred by the other for outside <br />services necessary for consideration of the proposed rate change, and <br />
