<br />141 <br /> <br />REGULAR MEETING OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS, NOVEMBER 10, 1975 <br /> <br />Present: <br /> <br />Mayor <br /> <br />Emmie Craddock <br /> <br />Councilmen <br /> <br />Frank T. Arredondo <br />Ted Breihan <br />Bill Dibrell <br />Luciano H. Flores <br />John Hansen <br />Kenneth E. Sutton <br /> <br />II <br /> <br />City Manager <br />City Attorney <br />City Secretary <br />Director of Finance <br /> <br />James B. Baugh <br />Tom Akins <br />Doriss Hambrick <br />Earl T. Williams <br /> <br />Also present: The Rev. Samuel Montoya; Charles West; Warren Leddick; <br />James Broussard; Shirley Wickersham; Melissa Millecam; <br />Juan Palomo; Jerri Martin; Terry Roberts; Paul Alexander; <br />and others. <br /> <br />The Mayor called the meeting to order at 7:30 p.m. <br /> <br />The Minutes of the Regular Meeting held October 13, 1975, were approved on <br />motion of Mr. Sutton and second of Mr. Hansen. <br /> <br />The Minutes of the Regular Meeting held October 20, 1975, were approved on <br />motion of Mr. Hansen and second of Mr. Sutton. <br /> <br />I <br /> <br />Mr. Hansen moved approval of the Minutes of the Special Meeting held November 3, <br />1975. Mr. Arredondo seconded the motion. Mr. Breihan requested they be amended <br />to read, on liJre 30, "elect" Mr. Dibrell's succesSOr. On roll call, the motion <br />to approve the Minutes, as amended, was approved with six votes in favor and <br />Mr. Dibrell in abstention. <br /> <br />The Mayor opened a Public Hearing to consider a change in the zoning of Lots 4, <br />5 and 6, Block 7 of the C.D. Wallace Addition from "R-l" to "P-2". There were <br />no objections presented to the change in zoning. There were no representatives <br />from the Planning and Zoning Commission nor the Pentecostal Local Church, owners <br />of the property in question. The Mayor closed the hearing and read the ordinance, <br />the caption of which is as follows: <br /> <br />AN ORDINANCE AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND <br />RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, <br />DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF LOTS 4, 5 AND 6, <br />BLOCK 7 OF THE C.D. WALLACE ADDITION, LOCATED AT 208 LAREDO STREET, <br />FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "P-2" (PUBLIC USE). <br /> <br />I <br /> <br />Mr. Flores moved the Ordinance be tabled since no One was present to request <br />the change. Mr. Sutton seconded the motion. At that time, the Reverend Samuel <br />Montoya, pastor of Pentecostal Local Church, arrived. Rev. Montoya explained that <br />the property was presently being used for church purposes, though the actual <br />zoning classification was "R_l". He further stated that the Planning and Zoning <br />Commission had arbitrarily initiated the change to bring the zoning into conformity <br />with the actual usage. Rev. Montoya said that the church had originally requested <br />renewal of a temporary permit for a mobile home located on the property, and had <br />been informed that if the zoning were changed, a permit would be unnece ssary. For <br />that reason, they wished the Council to take action on the ordinance as soon as <br />possible. Since Rev. Montoya was present, Mr. Flores withdrew his motion to table, <br />with consent of the seconder, and requested the Planning and Zoning Commission be <br />requested to send a representative to each Council meeting. Mr. Arredondo moved <br />the Ordinance be approved on first reading. Mr. Sutton seconded the motion. On <br />roll call, the following vote was recorded: <br /> <br />AYE: Craddock, Flores, Hansen, Sutton, Arredondo, Dibrell <br />NAY: Breihan. <br /> <br />Mr. Breihan requested the Council consider at a later date the ordinance which <br />allowed mobile homes to be placed in certain zoning classifications without permits. <br />
