<br />188 <br /> <br />regular meeting, january 26, 1976 <br /> <br />page two <br /> <br />The City Attorney presented a report on the question of modular structures in <br />residential areas. It is attached and made a part of these minutes. Mr. Sutton <br />suggested the Council consider calling for a referendum on the issue to let the <br />citizens decide whether modular structures should be allowed in residential <br />areas without restriction. Mr. Flores stated his contention that citizens of a <br />neighborhood should be allowed to restrict the placement of modular structures <br />in the same manner that mobile homes are restricted. The Mayor read an Ordinance <br />in its entirety, the caption of which is as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, REPEALING TRAT CERTAIN <br />ORDINANCE ENACTED JANUARY 12, 1976, DECLARING A MORATORIUM ON THE <br />ISSUANCE OF BUILDING PERMITS FOR RESIDENTIAL MODULAR CONSTRUCTION FOR <br />A PERIOD OF SIXTY (60) DAYS; AND DECLARING AN EMERGENCY. <br /> <br />I <br /> <br />~tr. Hansen moved adoption of the Ordinance. Mr. Arredondo seconded the motion. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Arredondo, Breihan, Craddock, Flores, Hansen <br />NAY: Sutton. <br /> <br />The Mayor read an Ordinance in its entirety, the caption of which is as follows: <br /> <br />AN ORDINANCE OF THE CITY OF SAN MARCOS, TEXAS, REPEALING SECTION <br />105.6(b) OF THE SOUTHERN STANDARD BUILDING CODE, SAID CODE HAVING <br />BEEN PREVIOUSLY ADOPTED BY THE CITY, SAID SECTION PROVIDING FOR THE <br />PERMISSIVE ACCEPTANCE OF ENGINEER'S OR ARCHITECT'S AFFIDAVIT AND <br />CERTIFICATION OF COMPLIANCE WITH THE TERMS AND PROVISION OF. SAID <br />CODE; AND DECLARING AN EMERGENCY. <br /> <br />The Mayor read also Section 105.6(b) of the Southern Standard Building Code. <br />Mr. Arredondo moved approval of the Ordinance. Mr. Hansen seconded the motion. <br />Mrs. Shirley Wickersham urged the Council not to pass the Ordinance, stating <br />that the homeowner needed the protection afforded by the Section. Mr. Arredondo <br />suggested the Council amend the Building Code to provide for both affidavits and <br />on-site inspection by the city building inspector as well. Mayor Craddock <br />pointed out the difficulty in sending the city inspector to the factory to inspect <br />the structures during their construction. On roll call, the motion to approve' <br />the Ordinance failed with the following vote: <br /> <br />AYE: Arredondo, Sutton <br />NAY: Breihan, Craddock, Flores, Hansen. <br /> <br />I <br /> <br />The City Attorney was instructed to continue to study the situation and try to <br />find alternative legal remedies. <br /> <br />Mr. Hansen moved to confirm the appointments of W.R. Nelson as Director of <br />Public Safety, Marvin Kaderli as Commander of Uniformed Patrol and Tommy <br />Ragsdale as Commander of Fire Suppression and Prevention. Mr. Breihan seconded <br />the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration the recommendations made by the 1974 Charter <br />Revision Commission. She reported that the recommendations had been discussed <br />at a workshop of the Counc.il held January 19; that the recommendations had been <br />presented by James Broussard, Chairman of the 1974 Commission; and the objections <br />presented by representatives of the League of Women Voters to Recommendation #2 (see <br />attachment) . Mr. Sutton moved, in view of the fact that a new Commission will be <br />appointed in July, 1976, to not call a charter revision referendum this year. <br />Mr. Hansen seconded the motion, which passed unanimously. <br /> <br />Bob Derrick, representing Forrest and Cotten, came before the Council will final <br />plans for the Drainage Confluence under the Community Development Program. <br />Mr. Hansen moved to authorize the engineers to proceed with bidding the project. <br />Mr. Flores seconded the motion, whioh passed unanimously. <br /> <br />I <br /> <br />James E. Byrn came before the Council with final plans for the Bluebonnet Citcle <br />area improvements. Mr. Byrn reported that the easements required for the proj ect <br />were somewhat of a problem, but that it appeared the project could feasibly be <br />done. Mr. Sutton moved to approve the project as :submitted by Mr. Byrn, and to <br />require that Council approval be obtained to proceeding with the project should <br />the cost be increased due to acquisition of ea~ements. Mr. Hansen seconded the <br />motion, which passed unanimously. <br />
