AND NOTICE OF INTENTION TO ISSUE WARRANTS IN PAYMENT OF ALL OR A PART OF rtiE CONTRACT PRICE. c =::: ~ t'V C // VffiEREAS. the City Council deems it 'advisable and necessary to con- struct certain extensions and improvements to the waterworks system and the sewer sy.tem of the City of San Marcos. Texas; and WHEREAS. the City Council deems it advisable and necessary to issue I interest bearing time warrants of said City to evidence the indebtedness' of the City to be incurred in constructing such extensions and improvements, such warrants to be payable from an ad valorem tax upo~ all taxable pro- perty in the City of San Marcos; and. WHER,,;AS. the City Council deems it advisable and to the best inter- est of zaid City to give notice to bidders and notice of intention to pay all or a part of the contract price by the issuance and deliv~ry of such interest bearing time warrants; HE IT R8S0LVED BY THE CrIT COUNCIL OF THE CITY OF SA.l'{ If.ARCOS. TEXAS: That the Mayor be and he' is hereby authorized. ordered and directed to do all things necessary and/or convenient to have published, the notice required by Chapter 163. Acts of the Regular Session of the 42nd Legislature of Texas, as amended; that said notice shall signify the intention of the City Council to receive bids for the construction of extensions and improve- ments to the waterworks system and the sewer sytem of the City of San Marcos and shall specify the time and place when and where bids will be received, and it shall be published in said City onee each week for,two consecutive weeks prior to the time set for receiving bids. the date of first publication to be at least fourteen (14) full days prior to the date set for receiving bids; said notice shall provide that all bids shall be accompanied by a bidder's bond or certified check in the sum of five (Q%) per cent of the total amount of the bid; that said notice shall also convey the informa- I tion that it is the intention of the City to pa~ all or apart of the contract rrice by the issuance and delivery of~~nterest bearing time warrants ~n an amount not exceeding $35,000.00, to bear interest at a rat~ not to ~xceed three and one-half (3-1/2%) per cent per annum. and hav~ng a.max~mum maturity date not later ~han twenty-five (25) years, from the~r date. to be. authorized by the City Council of said City for the purpose of evidenc~ng the indebtedness of the City of San Marcos to be incurred in constructing extensions and improvements to the waterworks system ~d. the s ewer system of said City; and said notice shall contaih such add~t~onal ,information which shall be deemed necessary; and that said notice shall be substantially in words and figures as, shown in the form attached hereto.
