8 Regular Meeting April 13, 1981 Page 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 47.6 ACRES OUT OF J. M. VE~AMENDI LEAGUE NO. ONE, LOCATED ON HUNTER ROAD, FROM "AO" (AGRICULTURAL-OPEN SPACE DISTRICT) TO "C" (COMMERCIAL). Mrs. Norris moved to adopt the Ordinance and Mr. Tarbutton seconded the motion, which passed unanimously. Mr. Stokes introduced for consideration an Ordinance on third and final reading, the caption of which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~.~RCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED SEPTEMBER 29, 1980 (VOL. 54) BY ZONING 30 ACRES OUT OF THE RIVER RUN SUBDI- VISION, LOCATED ON RIVER ROAD, FROM "AO" (AGRI- CULTURAL-OPEN SPACE DISTRICT) TO "D" (MULTI- F~ILY DWELLING DISTRICT). City Manager Gonzalez discussed that Mr. Salinas may withdraw but has not made a final decision to do so. The distinct difference in this zoning request is that the property has already been subdi- vided, which was approved by the City by default, when the P and Z did not take action within the thirty days. At that time there were memoranda by the City Staff recommending the variances sought by the developer not be approved and that the utility provisions in said subdivision ordinance at that time should be carried out; they were not. Mrs. Norris moved to table the Ordinance and Mr. James seconded the motion, which passed unanimously. Mr. Stokes indicated to Robert Boyd, the developer, that he hoped the problems would be resolved in the next two weeks. Mr. Stokes introduced for consideration an Ordinance on third and final reading, the caption of which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN ~RCOS, TEXAS ANNEXING TO SAID CITY A CONTIGUOUS TRACT OF LAND CONTAINING APPROXI- MATELY 57.67 ACRES OF LAND, MORE OR LESS, LO- CATED WITHIN THE EXTRATERRITORIAL JURISDICTION OF SAID CITY AND LYING ADJACENT TO PRESENT CITY BOUNDARIES; EXTENDING THE BOUNDARY LIMITS OF SAID CITY SO AS TO INCLUDE SAID TRACT; GRANTING TO THE INHABITANTS OF SAID TRACT ALL THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS OF SAID CITY; BINDING SAID INHABITANTS BY ALL OF THE ACTS AND ORDINANCES, RULES AND REGULATIONS OF SAID CITY AND DECLARING AN EFFECTIVE DATE, Mrs. Norris moved to adopt the Ordinance and Mr. Stokes seconded the motion, which passed unanimously. Mr. Stokes introduced for consideration the granting of a franchise to River Taxi Service on third and final reading, the caption of which was read as follows:
